12 <br /> Board of Selectmen <br /> Minutes <br /> August 19, 2019 <br /> At #17: Conservation Department—To correct an incorrect regulatory citation; Wetlands Protection Act. <br /> Motion made by Selectman Sherman to recommend approval of Article#17 on the October warrant. <br /> Motion seconded by Selectman O'Hara. <br /> VOTE: Unanimous. 4-0. <br /> Selectman Gottlieb,yes Selectman Cotton,yes Selectman O'Hara,yes <br /> Selectman Sherman,yes Opposed, none <br /> Article#18: Conservation Department—To amend General Bylaws to accurately reflect current procedures. <br /> Article#19: Conservation Department—To amend General Bylaw's requiring authorization of requested <br /> activity from the property owner at the time of filing, and mailing of notice and copy of the permit <br /> application. <br /> Article #20: Conservation Department—To amend General Bylaws to establish consistency of proper <br /> terminology with Bylaw and Wetlands Protection Act. <br /> Article#21: Conservation Department—To amend General Bylaws; term to existing conditions. <br /> Article #22: Conservation Department—To amend General Bylaws to provide consistency of proper <br /> terminology with Bylaw and Wetlands Protection Act. <br /> Article #23: Conservation Department—To amend General Bylaws to reflect changes to other state agencies in <br /> the bylaw language; housekeeping item. <br /> Article #24: Conservation Department—To amend General Bylaws to not restrict the commission to a cap <br /> of$300 for non-criminal offenses. <br /> Motion made by Selectman Sherman to recommend approval of Articles #18424 on the October warrant. <br /> Motion seconded by Selectman Cotton. <br /> VOTE: Unanimous. 4-0. <br /> Selectman Gottlieb,yes Selectman Cotton,yes Selectman O'Hara,yes <br /> Selectman Sherman,yes Opposed, none <br /> Article#25: Accessory Apartment- *New version of Article to reflect amendments recommended by the <br /> Planning Board. Correspondence from the Town Planner dated August 13, 2019 outlined the <br /> unanimous recommendations of the Planning Board regarding the proposed Accessory Apartment <br /> Bylaw. Changes were made in Subsection B, E and I. <br /> Subsection A also clarifies the ownership of the property. Mary Waygan, Planning Board Chair indicated <br /> the proposed Bylaw under Subsection A states: On an annual basis coinciding with the initial date of issuance of <br /> the Building Permit,the property owner shall submit to the Building Inspector sufficient evidence to demonstrate <br /> occupancy of the principal dwelling unit. This action allows flexibility to the Building Inspector to ensure the <br /> owner is actually residing at the property <br /> As the matter was discussed it was the agreement of the Board of Selectmen to further define the language <br /> regarding ownership to include the appropriate trustee, managing principal of an LLC or management structure. <br /> It was agreed the additional language would be further reviewed by the Board of Selectmen at their August 22, <br /> 2019 meeting. <br />
