Article 22 <br /> To see if the Town will vote to amend Chapter 172-7(A) (3) (a) as follows: <br /> Replace the phrase "preexisting conditions"to "existing conditions"in the following sentence under this <br /> subsection "Such waivers are intended to be granted only in rare and unusual cases and only when <br /> resource protection would be enhanced relative to preexisting conditions" <br /> or take any other action relating thereto. <br /> Submitted by the Conservation Department <br /> Explanation:The term "existing conditions"is a more appropriate term under the context of this bylaw <br /> subsection. <br /> The Board of Selectmen recommends approval of Article 22 by a vote of 4-0 <br /> The Finance Committee recommends approval of Article 22 by a vote of 6-0 <br /> MOTION TO BE MADE BY SELECTMAN COTTON: <br /> I move the Town vote to approve Article 22 as printed in the warrant with the <br /> exception of the phrase, "or take any other action relating thereto." <br /> Article 23 <br /> To see if the Town will vote to amend Chapter 172-9 of the General Bylaws as follows: <br /> Amend the language of 172-9(A) to include the term "Adverse Impact" and its definition as follows: <br /> "Adverse Impact-Adverse impact means an impact to the value or interest of a wetland resource area <br /> as defined by the bylaw that is deemed by the issuing authority to be more than negligible, or random, <br /> unnecessary or undesirable to the public interests of the resource area. Negligible means insignificant <br /> to the values or interests of the resource area" <br /> or take any other action relating thereto. <br /> Submitted by the Conservation Department <br /> Explanation: The term "adverse impact" is commonly referenced in the regulatory language of the <br /> Massachusetts State Wetland Protection Act as a barometer of impact thresholds within wetlands <br /> jurisdiction.
