<br /> RE: New Bedford ""waste Services(NBWS "waste Disposal Agreement
<br /> Description
<br /> NBWS,is requesting the Town amend the existing Waste Disposal Agreement for an increase in the tip
<br /> fee to$93.75 per ton for Calendar Year 2020.
<br /> Background
<br /> The Torn entered into a 10-year agreement with NBWS for disposal of solid waste, effective January 1,
<br /> 2015. Per this agreement,the Town paid a tip fee of$55 per ton for CY15 and CY1 . A 2.5%escalation
<br /> is applied each year, starting on January 1, 2017. The current tip fee for CY19 is$59.23/ton. It will
<br /> increase to$60.71 per ton on January 1, 2020
<br /> The Town received a letter from NBWS dated August 9, 2019 stating that the tip fee would increase to
<br /> $175 per ton, effective October 1, 20191, NBWS proposed this increase under the"force majeure"
<br /> provision of the agreement due to poor recycling markets and decreasing end disposal options for trash
<br /> in Massachusetts. The Torn responded to NBWS via letter dated September 23, 2019, rejecting the
<br /> argument that these conditions qualified as a "force majeure".
<br /> Mike Camera, General Manager for NBWS, attended the Board of Selectmen meeting on November 4 t
<br /> .At the meeting., he presented his argument main for an increase tip fee but stated the fee proposed was
<br /> $60.60, per ton, not$75. The Board reiterated the To vn's positron that an increase per the 'force
<br /> ma cure" provision of the agreement was no aippiropriate but stated they would consider negotiating an
<br /> amendment to the agreement for an increase in the tip fee. They directed staff to meet with Mr.
<br /> Camera.
<br /> The.Assistant Town Mainager and I met with Mike Camera aind Jerry Dugan, also from NBWS, on
<br /> November 21$. At this meeting, Mr.Camera stated that NBWS was proposing to bale IVISW for
<br /> shipment by truck out of state. NBWS is currently negotiating contracts with, disposal facilities in several
<br /> other states. Mashpee would haul MWS from the Transfer Station to the NBWS facility in Rochester,
<br /> MA.
