Sighting a similar case , .a Bryant ' s Neck resident asked what <br /> happens with respect to this offer if the developer sells <br /> the development and then the new owner goes bankrupt . Mr . <br /> Dubin replied that for the short term, the road can be <br /> analyzed and if it needs work before the developer is <br /> relelased from his obligations , he would have to bring it up <br /> to present standards . <br /> Mr . Dubin asked Charles Rowley for comments on the <br /> engineering reports recieved. Mr . Rowley that he would need <br /> more time to respond to that request ; however , he did <br /> comment that Santuit Pond Rd is in better shape than Asa <br /> Meigs . He also questioned how much of the KV report is based <br /> on other studies and whether further field studies should be <br /> done . He then raised a question as to DEOE approval of the <br /> wells and of the well location . Ms . Wilson replied that they <br /> had completed samplings for DEQE , however unless DEQE <br /> approves the wells they would not be sued any permits and <br /> would have to come back to the Board with modifications or <br /> design changes - at this point the Board need only approve <br /> the well locations . Mr . Rowley stated that he can' t give <br /> recommendations on the sizing of the well system, knowing <br /> nothing about the pumping unit and what will be involved. <br /> Regarding access to well road, Mr . Rowley recommended that <br /> the non-draining roads be taken out and suitable gravel be <br /> put in place . He also stated that in regard to the dry <br /> hydrant , he would like to see the structure for pumping <br /> water from the pond and he would like to see the fire access <br /> road shortened. <br /> Discussion ensued as to the legalities of voting with the <br /> building moratorium before the Town Meeting . <br /> It was agreed to vote , and Mr . Dubin put_ a Motion before the <br /> Board to approve 52 units , delete Building 15 , relocate <br /> Building 14 , delete an additional building and shorten the <br /> fire road , subject to rejection of the moratorium by Town <br /> Meeting . Mr . Ferr.agamo questioned whether the revised plan <br /> would come back to the Board - Mr . Dubin responded that it <br /> would and that the approval was subject to the provision <br /> that satisfactory revised plans are submitted. Mr . <br /> Ferragamo seconded the Motion . Motion passed. <br /> Mr . Dubin stated that although it needn ' t be pars of the <br /> vote , it should be noted on the Revised Plan that Lots 55 <br /> and 56 are not buildable Iots , He also asked Mr . Karine to <br /> included in the covenant that the developer iviI1 be <br /> responsible for maintenance of San tuit Pond Rd from the <br /> entrance of the condominimums to Asa Meigs, Rd . <br />
