Mr . Dubin bought up Mr . Fudala- s written comment that the <br /> development is located in the recharge area - and the <br /> building inspector has been authorized not to grant an.v <br /> building permits . <br /> Mr . Karine submitted that the moratorium has been presented <br /> to the Town as a zoning article and should be treated as <br /> usual and would not be applicable to the development . <br /> Mr . Dubin stated that there is no statutory protection from <br /> special permit , although the Board may continue to consider <br /> the plan under the old section 9 . 3 . Mr . Dubin reiterated <br /> his feeling that the development should be entitled to the <br /> old zoning. <br /> Mr . Dubin again brought up the question of phosphorus <br /> loading . K. Karine suggested that should the Board accept <br /> the plan , the Board might stipulate the condition that no <br /> septic system be placed within 300 feet of the pond . <br /> Mr . Dubin again introduced comments submitted by Town <br /> Planner , Tom Fudala . Mr Fudala restated that the according <br /> to Town Counsel the correct comparison figure should be <br /> 26-27 single family residences - developed on a simlilar <br /> scale as that of the Boudreau property which is located next <br /> to this development and the area is similar in size to the <br /> Beachwood development . <br /> Mr . Fudala reiterated that there is nothing that can be done <br /> about existing phosphorus loading at the pond , all that can <br /> be done is to minimize the impact of the 4 projects proposed <br /> in the Santuit Pond area . <br /> Mr . Fudala further commented that although the traffic <br /> comparison report states that the amount of traffic on the <br /> area roads is suitable for .a residential co) Iector street <br /> according to ITE - neither Asa Meigs or Santuit Pond Roads <br /> come close to meeting ITE standards ; and , in fact , most of <br /> the roads in that area are in bad shape . <br /> Mr . Fudala continued that Beachwood Point would be a high <br /> density multi -family development in conflict with the single <br /> family developments on either side . Mr . Fudala suggested <br /> that the;.11 use the 26-27 un i t comparison -f i guru or deny the <br /> plan . <br /> Mr .
