Mr. Garnick stated that he would write a
letter agreeing to continue the hearing until November 6; however, he wanted it
clear that he was reserving his rights to argue that the plan was approved by
inaction. The hearing was continued until November 6.
Public Hearing: Henry C. Labute/Lovell Realty Trust (contld)
North side of Quashnet (William Mingo) Road at Great Hay,
Grafton Pocknet, Bog House Roads and Ashers Path
Definitive Plan approval of 48—lot "Steeplechase" cluster
subdivision
For the purpose of the continuing of this hearing, Mr. Dubin abstained and Mr.
Jonas took the chair. Mr. Gilmore and Tor. Rowley submitted an agreement that
$hey had worked out. Mr. Jonas read it aloud. It stated that the plan is
approved subject to the engineering comments, a 40 ft. lay—out of William Mingo
Road from Lovell and Quashnet Roads southwesterly 400 feet plus/minus to Saddle—
back Road, and to the submittal and approval of engineering plans for the
construction of that portion of William Mingo Road. Mr. Jonas moved to approve
the plan. Mr. Ferragamo seconded the motion and the Board voted unanimously in
favor.
Approval—Not—Required: T.Q Gregoire
Old Mill Road
Discussion of A.N.R. plan to merge two lots
Mr. Gregoire owns 10-1/2 acres. He had two parcels, now he wants to combine them
into one lot. Mr. William Nye stated that in 1973, Parcel B was to be conveyed
to Allen Ryder. It never was. Mr. Gregoire purchased the property and started
building a house on it. A title attorney discovered it, and, at that time, the
Planning Board told him that if he brought back the plan showing one parcel,
they would sign it as approval—not—required. It was requested that Mr. Nye add
to the plan a notation that no further division of lots would be allowed without
further Planning Board approval. Mr. Collins made a motion to approve the plan
contingent upon Mr. Nye added the requested notation. Mr. Ferragamo seconded the
motion and the Board voted unanimously in favor. It was decided that the Board
would sign the plan after Mr. Nye added the notation.
Definitive Subdivision Plan: Elise M. Otis, et al by Baxter and Nye, Inc.
West side of Central and Lowell Roads, north of
Ashers Path and east of Lovell's Lane
Signature of Definitive Plan of 49—lot subdivision
Mr. Michael Ford supplied the requested executed covenants. Mr. Nye stated that
the plan had been revised in accordance with Mr. Rowley' s comments. The Board
members signed the original plan, but decided that, in the interest of time, they
would either sign the copies later or else they would all come in and sign them
at a later date.
