Mr. Richard Shaughnessy' <br /> representing Briant' s Neck Association and Timberlane Association, requested <br /> that the approval and the signing of this plan be held off until November 20, <br /> along with the rest of the plans involving Santuit Pond. Mr. Dubin stated that <br /> this plan was not like the others in that it does not create lots or house units. <br /> It is a perimeter plan establishing general areas. Mr. Dubin assured Mr. Shaughnessy <br /> that, at the appropriate time, the Board will take into account the abutters and <br /> the affect on the pond. Mr. Dubin asked if the signed covenant would be provided <br /> at the November 6 meeting. Mr. Nye requested that he and Mr. Rowley get together <br /> before the next meeting to go over the changes. <br /> At this time, the Board signed the A.N.R. Plan for Leo Gregoire. <br /> Definitive Subdivision Plan: New Seabury Corporation <br /> Red Brook/Great Oak/Great Hay/Amy Brown Roads <br /> Di3cussion of application process for "Bufflehead <br /> Bay" development. Under Section 9.3 or 9.4? <br /> Mr. Rick Lamb, landscape architect for New Seabury Corporation said that he had <br /> two questions. There has been discussion on whether the Bufflehead Bay project <br /> falls under Section 9.3 or 9.4. They originally presented the project under <br /> Section 9.3, which allows for some cluster development. Mr. Dubin stated that, <br /> at one point, they had decided they were under Section 9.4 because they didn't <br /> have any multi-family. Mr. Fudala suggested that they should file for special <br /> permit application. Mr. Lamb stated that they would. There was then a discussion <br /> on the scale of the plan. Mr. Rowley said that as long as he could see the detail, <br /> and it was appropriate to the plan, the scale was alright with him. <br /> Preliminary Subdivision Plan: LaCava Trust <br /> Old Barnstable-Falmouth Road/Country Club Way <br /> Preliminary Plan approval of 74-lot subdivision <br /> at quashnet Valley Country Club <br /> Mr. Dubin asked if anyone was present representing LaCava Trust. There was no <br /> response. Mr. Fudala pointed out that the Board had to act on this plan at this <br /> meeting as no request for extention had been received. The plan was submitted <br /> on August 21 and was scheduled for review on September 4 and September 18. The <br /> applicant requested postponements both times. The 60-day review period expires <br /> on October 20. Mr. Fudala stated that the reason it was delayed was because <br /> they were waiting for an opinion from Town Counsel on whether the special permit <br /> was still valid.
