MA 02649 <br /> PLANNING BOARD MINUTES OCTOBER 16, 1985 PAGE 7 <br /> Dubin stated that the plan had inadequate open space and that they needed more <br /> guidance on whether the special permit was still valid. Ms. Stone made a motion <br /> to deny the plan because of inadequate open space and because the applicant has <br /> not established, to the Board' s satisfaction, the fact that he is entitled to <br /> subdivide into multi-family lots. Mr. Collins seconded the motion and the Board <br /> voted unanimously in favor. <br /> Preliminary Subdivision Plan: Haxborview Construction <br /> South side of Ashers Path at High Sachem Road <br /> Discussion on development of expired subdivision and <br /> updating incomplete subdivision roads <br /> When this plan was before the Board two weeks ago, Mr. Rowley had said that he <br /> would review the plan and give guidance. Mr. Rowley stated that he has not had <br /> the time to look at the streets. He will look at them October 17, as he will <br /> be in Mashpee, and then he will give guidance. The performance bond cannot be <br /> obtained until Mr. Rowley has given some guidance. The hearing was continued <br /> until November 6. <br /> Preliminary Subdivision Plan: Barbara Grant <br /> Lot 209 Hoopole Road <br /> Ms. Grant stated that he had just purchased a house from her brother and, in doing <br /> a title search, her attorney found that there was only a partial release of the lots <br /> for this plan, releasing Section 1. He didn't know if that also released Sections <br /> 2 and 3 and thought it should be looked into. Ms. Grant filled out a covenant and <br /> submitted it to the Board. Mr. Collins moved to release Lot 209 from the covenant. <br /> Mr. Jonas seconded the motion and the Board voted unanimously in favor. Kevin Kirrane <br /> notarized it. <br /> Preliminary Subdivision Plan: Northport Realty Trust <br /> Ashumet Road <br /> Preliminary Plan review of 29-lot cluster subdivision <br /> Mr. Michael McGrath stated that this plan was signed about a month ago. At that <br /> time, the Board told him to come back tonight and they would comment . It was a <br /> cluster with 610,0 open space. The Board of Health wanted the plan to show the dis- <br /> tance of the wells from the septic tanks, show the MDC drains and question the <br /> boundary dimensions of area, and refer to land compatability with Otis Air Force <br /> Base. Mr. Dubin suggested that Mr. McGrath research it and find out what type <br /> of zoning it is in to make sure it is not a zone that they don't recommend resi- <br /> dential development because of Otis. There are 29 maximum allowable lots and the <br /> plan has 29 lots. Usually, the Board does not allow the maximum allowable lots, <br /> but this plan has so much open space. Mr. Collins moved to approve the plan subject <br /> to compliance with the Board of Health requirements and police and fire departments <br /> letters of approval. Mr. Ferragamo seconded the motion and the Board voted unani- <br /> mously in favor. <br />
