We 'll insist on that <br /> being shown on the plans so the public has notice that the rights exist . <br /> The main thing I see here is an additional hearing called for where <br /> you're looking to relocate a road . It looks like something we 've <br /> been missing. Like Bryant 's Cove - they want to cut it down toward <br /> the water a little more . So I guess we should be looking for them to <br /> have a hearing before the Board of Selectmen if that 's what the state <br /> requires . <br /> Mr. Fudala: Legally you have to go through the right steps . <br /> Mr. Dubin: That makes some sense to me . That 's the one thing on that <br /> plan that bothered me always . It makes sense from that point of view <br /> and they argued that the public would still have a right of way over <br /> that area . <br /> Ms . Tanneyhill : Yes but what about Simon's Narrow? Simon's Narrow <br /> runs down to the water. <br /> Mr. Dubin: They never tried to cliam that the public doesn't have <br /> rights over that . Well actually they have but we didn't let it go <br /> through that way. There was at one time a line drawn across the road <br /> before the road got to the dock but that line was taken off the plan. <br /> Ms . Tanneyhill: We were not aware of that because that was one of <br /> the things that concerned us a great deal . After you left Quaker Run <br /> you couldn't get to the water. <br /> Mr. Dubin: Suffice to say the Planning Board shares your concerns . <br /> It 's one of those things we look for. We don't want to see any ancient <br /> ways access across those blocked. As Earle was saying we all subscribe <br /> to the theory that some of these ancient ways are going to be paved and <br /> improved. If they're just simply left where they are their present <br /> alignment is followed then we think that 's within the owner's rights . <br /> Hoever it may be a good idea to call for an additional hearing when <br /> there 's going to be a relocation. As I see it that 's still the main <br /> question that somebody would look at on this article . Because otherwise <br /> we already subscribe to the sense of the article . The only practical <br /> question is whether we want to have the Selectmen get involved in the <br /> process of evaluating these relocations . <br /> Ms . Averett : Are you saying if you have another hearing this article <br /> will not be able to come up at town meeting? <br /> Mr. Fudala: No, he 's talking about an individual hearing on a particular <br />
