One of the things this does is make <br /> a presumption in favor of a road 's public status versus presuming it 's <br /> not a public road in a lot of these cases . It makes it more careful <br /> when referring ancient way. Let me make something clear. The map that <br /> was filed includes lots of things . Take Route 28 . Lots of things that <br /> are ancient roads that are public and used quite heavily. It 's not <br /> just these woods roads . It doesn't include , except 1 or 2 instances , <br /> any road that doesn't appear on-zoning map. . . <br /> Mr. Dubin: It has all of those? <br /> Mr. Fudala: Most of those . <br /> Mr. Dubin: Some of those are virtually abandoned . <br /> Mr . Fudala: It gets down to use of the road versus some legal status . <br /> Town roads , public roads , it 's very confusing. I think the intent of <br /> the article is to make sure you go through all the right steps before <br /> you. . . . One thing that hadn't been mentioned, everything in here <br /> doesn 't necessarily apply to just the Planning Board. <br /> Mr. Marsters : Can you get copies of that map Tom? Somebody must <br /> have an original . <br /> Mr. Fudala : I can make a copy of it by hand. <br /> Mr. Jonas : You mean the Board of Selectmen are the only ones who have <br /> a right to hold a public heating on it? <br /> Mr. Fudala: Right . It talks about public way and this is where we get <br /> down to this question. This is making the presumption they do have <br /> some public status . <br /> Mr. Jonas : So you say the Board of Selectmen are the only ones who <br /> can hold a public hearing? <br /> Mr. Fudala: Right . To relocate or alter. To abandon takes a town <br /> meeting . <br /> Mr. Marsters : The 301 bothers me . <br /> Mr. Rowley: Do you know if Town Counsel has had a chance to look at this <br /> particular article? <br /> Mr. Dubin: I don't know. <br /> Mr. Rowley: The reason why I ask the question is the last sentence <br />
