I think you questioned them on the ones you thought they <br /> hadn't done their job on and found they weren't involved in them at <br /> all. Design Review has done their job in every single case . <br /> Mr. Fudala: I still think Madaket Place which they did review is not <br /> proper even under the current wording. <br /> Mr. Marsters : That 's a matter of judgement . <br /> Mr. Dubin: Any other comments from the public on this proposed article? <br /> (there were none ) . The Board will take this article under advisement . <br /> Mr. Dubin opened the public hearing on amending Section 4 of the Zoning <br /> By-Laws . He read the notice as advertised in the newspaper (see <br /> attached) . <br /> Mr. Dubin: This your article , Tom? <br /> Mr. Fudala: It was submitted by the Historical Commission and by petition. <br /> Mr. Dubin: Anybody here from Historical Commission on this article care <br /> to offer any comments? <br /> Anna Tanneyhill: The Historical Commission is charged with preserving <br /> the historic ways , sites and buildings and with the rapid growth of the <br /> town and developments moving in and new buildings , there is fear that <br /> some of the old roads may be abandoned or built on or something would <br /> be done so that access to water or to wherever road is leading would <br /> be lost and that is :our concern. Not only building sites but roads should <br /> be preserved. Briefly that 's our position. <br /> Mr. Dubin: It looks like probably the most innovative part of this is <br /> that there 's going to be another hearing. Now as things stand now the <br /> Planning Board typically would not allow the abandonment of an ancient <br /> way. Any road shown that we know about I think we protect . However if <br /> I understand the article this would require a separate hearing. We 've <br /> had a few cases where people came in and seek to relocate dirt roads or <br /> ancient ways as it stands now, it doesn't require a hearing before the <br /> Selectmen. <br />
