MA 02649 PUBLIC HEARING NOTICE Pursuant to Chapter 40A of Massachusetts General Law, -the Mashpee Planning Board will conduct a public hearing at 8 :35 PM on Wednesday, May 1, 1985, at Town Hall , Central Road , Mashpee on a proposed amendment to the Zoning By-Laws as follows : To Section 4 add -the following new Subsection: 4.10 In order to provide for the protection of public rights and interests in roads , ways and historic accesses to water, this subsection is established to regulate the use , relocation, alteration or discontinuance of such roads , ways and accesses . The term "way" as used in this subsection shall include Scenic and Historic Ways shown as such on a map entitled "Scenic and Historic Ways of the Town of Mashpee" on file in the office of -the Town Clerk and to any other way which has become , by Town action or by prescriptive use , a public way. Where a way has been surveyed and laid out , the pro- visions of this subsection shall be applicable to all lands within said layout . Otherwise , they shall be applicable to all lands within thirty (30) feet of the centerline of such ways as they appear on the ground. 4.10.1 No building or other structure may be located on, or in such a manner as to interfere with public access to , or use of, such a way. 4.10.2 No fence , pole , curb or other similar object may be located in such a manner as -to interfere with public , access to, or use of, such a way, 4.10.3 No subdivision or other division of land shall be created, nor any road be laid out , in such a manner as -to inter- fere with public access to, or use of, such a way or to encourage the siting of buildings , wells , wastewater facilities , utilities or other improvements in such a manner as -to interfere with public access to, or use nf- qunh �. wnir_
