Town of Mashpee <br /> PUBLIC HEARING NOTICE <br /> Pursuant to Chapter 40A of Massachusetts General Law, the <br /> Mashpee Planning Board will conduct a public hearing at 8 :20 PM <br /> on Wednesday, April 24, 1985, at Town Hall , Central Road , [a'ashpee <br /> on a proposed amendment to Section 11, of the Zoning By-Laws by <br /> deleting therefrom the present subsections 14.3 through 14—5, and <br /> substituting therefore the following new subsections 14. 3 , 14 .4, <br /> 14.5, 14.6 and 14.7 as follows : <br /> 1114.3 This zoning by-law shall be enforced by the Building Inspector who, <br /> upon being informed in writing of a possible violation of this by-taw, <br /> or on his own initiative, shall make or cause to be made an investigation <br /> of facts and an inspection of the premises where such violation is alleged <br /> to exist. The Building Inspector, after review and inspection as aforesaid, <br /> shall make a determination as to whether or not a violation exists. <br /> If the Building Inspector determines that a violation exists, he shall <br /> give written notice of such violation to the owner and to the occupant <br /> of such premises and shall demand that such violation be abated within <br /> a reasonable time as designated in the written notice. Such notice <br /> and demand may be given either in person or by mail addressed to <br /> the owner at the address appearing on the most recent assessing records <br /> of the Town and to the occupant at the address of the premises where <br /> the violation has occurred." <br /> 14.4 If the Building Inspector, after being requested in writing to enforce <br /> this zoning by-law against any violation thereof, declines to act, <br /> he shall notify, in writing, the party requesting such enforcement <br /> of any action of refusal to act, and the reasons therefore, within <br /> 14 days of receipt of such written request for enforcement. Any <br /> person aggrieved by reason of Inability to obtain enforcement action <br /> from the Building Inspector may appeal the decision not to act to <br /> the Board of Appeals. The Board of Appeals shall, at a public meeting, <br /> review the allegation of violation of the zoning by-law, the Building <br /> Inspector's reason for refusal to act, and any other information it <br /> deems necessary and relevant, and it may, by majority vote, decide <br /> to issue a notice of violation and demand for abatement in the same <br /> manner as prescribed for the Building Inspector in Subsection 14.3." <br />
