Tolun of gaspue
P. 0. BOX 1108
MASHPEE, MA 02649
PLANNING BOARD MINUTES : 4/17/85 P. 5
Mr . Dubin: It benefits the developer anyway riot us . A developer normally
comes to us with that bond at the point where he wants the covenant
released .
11,1-y-- lViarsters : This is a landscaping bond, that 's a road bond ,
Mr . Dubin:Wbll it 's sort of the same thing. You might come to the point
where nobody will challenge you because they either want to get there
covenant released or their landscape covenant released .
Mr . Piakunas (member of Board of Appeals ) : We don ' t have covenants , that 's
-the difference , -that 's the problem.
Mr . Dubin: That 's maybe it goes far enough . Rather than going any
further. We have enough power now with our covenants so that we perhaps
don't need the additional language .
Mr. PAlarsters : We could possibly include this in our road covenant .
If -there is a road covenant . There Isno road covenant on multi-family.
Mr . Makunas : multi-family is where the landscape , the looks , the approach
comes in. They say they're going to do this but unless you put a bond
there 's no way. . .
Mr. Dubin: There certainly should be , no question. Either that or a
covenant . A covenant would do the job but if it 's easier to have this . .
Mr . Makunas : Money seems to encourage them to do it .
Mr . Dubin: A covenant will work pretty- well .
Mr. Makunas : Only when they want to convey sorAhing. Sometimes they
don't want to do it . Then they want to convey the whole package to
somebody.
Mr . Dubin: That 's true .
Mr . Marsters : Then let 's go with it the way it is .
Mr . Rowley: One small technical question - at the end of the paragraph
it says excessive -traffic noise . is -there supposed to be a comma
between the words traffic and noise . Is it talkinL, specifically of
-traffic noise or -traffic comma, noise?
Mr . Makunas : There should be a comma there .
