Waygan, Chair <br /> Planning Board <br /> Date: January 6, 2020 <br /> Re: Request to include a zoning article on the May Town Meeting Warrant <br /> At its meeting of December 18, 2019 the Planning Board voted to request the Board of Selectmen <br /> reserve a place on the May 2020 Town Meeting Warrant for a zoning article that would amend the <br /> zoning bylaw to include reasonable restrictions and performance standards on the development of <br /> solar energy systems. <br /> The Mashpee Zoning bylaw only allows for the development of solar energy systems on industrially <br /> zoned parcels and does not include strong performance standards. M.G.L. Chapter 40A section 3 <br /> states, <br /> No zoning ordinance or by-law shall prohibit or unreasonably regulate the installation of solar <br /> energy systems or the building of structures that facilitate the collection of solar energy, except where <br /> necessary to protect the public health, safety or welfare. <br /> There has been growing interest from a number of developers in developing these systems on private <br /> property, Mashpee's zoning bylaw today may be perceived as prohibitive and unreasonably <br /> restrictive thus it is in the best interest of the town to enhance these regulations before a developer <br /> seeks a building permit or other approval. <br /> The Town Planner has presented a draft zoning bylaw to the Planning Board. The Planning Board <br /> will be working out this language over the coming months with the goal of presenting the proposed <br /> bylaw amendment to the Board of Selectmen prior to the warrant article submission deadline. <br /> MEW/el <br />
