AMENDMENT#2 to WASTE DISPOSAL AGREEMENT <br /> Between NEW BEDFORD WASTE SERVICES and the TOWN OF MASHPEE <br /> The AGREEMENT for waste disposal made on November 15, 2013 and amended on March 5, 2014, <br /> between the Town of'Mashpee,acting by and between its B,oard,of Selectmen, hereinafter referred to as <br /> "Town" and New Bedford Waste Services, LLC,with an address of 1245 Sh,awmut Avenue, New Bedford, <br /> MA 02746, hereinafter referred to as "'NBWS'p, is hereby amended in accordance with the provisions of <br /> said AGREEMENT as follows: <br /> 1. SERVICES PROVIDED AND DISPOSAL FEE. Effective January 1, 2020, the Town agrees to pay <br /> NBWS a disposal fee for Calendar Year 20�20 in an amount not to exceed ninety-three dollars and <br /> seventy-five cents($93.75) per ton, including all handling,transportation,and end disposal costs. <br /> This fee shall be adjusted monthly based on documentation provided by NBWS as required by <br /> Section 9C. of the AGREEMENT to substantiate the fee amount. NBWS shall include this <br /> documentation with each invoice issued. In no event shall this disposal fee exceed$93.75 per ton <br /> during Calendar Year 20,20 and NBWS shall not seek any further fee increase above $93.75 per <br /> ton in Calendar Year,2020. <br /> At least ninety(90) days prior to December 31, 2020, NBWS shall submit to the Town a proposed <br /> disposal fee for Calendar Year 2021.
