9,31 (Cont. ) <br /> Density shall not exceed the following: <br /> 3,000 square feet of land area for each one bedroom unit <br /> 6,000 square feet of land area for eaeh two bedroom unit <br /> 10,000 square feet of land area for each unit containing three <br /> (3) or more bedrooms. <br /> 9.4 Exception for Cluster Development <br /> 9.41 Purpose: To encourage the preservation of open space and promote <br /> the more efficient use of land, and to protect and promote the <br /> health, safety, convenience and general habitants. of the town. <br /> 9.42 Any provisions of Section 7 of this By-Law to the contrary not <br /> I <br /> withstanding the planning board may approve according to the <br /> Subdivision Control Procedures authorized on Chapter 41 of the <br /> General Laws of a subdivision plan in residential .district for <br /> a tract of ten (10) acres or more in which some or all of the lots <br /> do not conform to specifically the lot area, frontage, setback, <br /> or yard requirements of Section 7 of this By-Law provided that: <br /> 1 . The proposed plan will promote the purpose of this section. <br /> 2. The total number of lots for building purposes within the <br /> tract- shown on the plan shall be not more than the number of <br /> times that the total area of the tract, in square feet, ex- <br /> clusive of roads, is wholly divisible by the minimum lot <br /> size,' in square feet, normally required for the district <br /> in which the tract is located. <br /> i <br /> 3. The lots for building purposes shall be grouped in a. cluster <br /> or clusters, and within each cluster the lots shall be con- <br /> tiguous. <br /> 4. Every lot shall have a minimum frontage of senenty-five (75) <br /> feet on a public or private way. <br /> 5. The minimum lot width at the building line shall be not less <br /> than one hundred (100) feet. <br /> 6. Provision shall be made so that Open Land shall be owned: <br /> a) in common by the Owners of the lots in the tract, or, <br /> b Y. <br /> b a membership corporation, trust,or association whose <br /> members are all the Owners of the lots in the;.tract, or <br /> c) by the town, or <br /> d) otherwise as the .Planning Board may approve. <br /> 7. Proviisons shall be made so that Open Land shall be: <br /> a) restricted to any one or more of the following uses: <br /> (1) Restricted to any one or more of the following uses : <br /> recreational , agricultural , conservation or park. <br /> .(2) Open to such uses by at least the Owners and occu- <br /> pants of the lots in the tract. <br /> (3) Restricted so that no structure shall be erected thereon <br /> except as an incident to the above uses$ and no such <br /> structure shall be more than 15 feet in height, and <br /> -25- colt/mLTN= PLANNING SERVICES <br />
