24. 'FIRE INSURANCE <br /> Tenant shall not do or keep anything in, upon or about the Premises which will breach <br /> Landlord's policies 'insuring against loss or damage by fire or other hazards (including <br /> but not limited to public liability) or by which will prevent Landlord from procuring such <br /> policies in companies acceptable to Landlord. If anything done or omitted to be done, or <br /> kept or suffered to be kept by Tenant in, upon or about the Premises shall cause the rate <br /> of fire or other 'insurance on the Premises to be increased,, Tenant shall pay the amount of <br /> such increase promptiv upon Landlord's demand. <br /> Or <br /> 25. FIRE AND OTHER CASUALTY <br /> If the premises shall be damaged by fire, the elements, unavoidable accident or other <br /> casualty, but are not thereby rendered untenantable, in whole or in part, Landlord shall <br /> promptly, at its sole expense, cause such damage to be repaired and the rent shall not be <br /> abated. <br /> If, by any reason of such occurrence, the Premises shall be rendered untenantable only in <br /> part, Landlord shall promptly, at his own expense, cause the damage to be repaired, and <br /> the rent shall be abated proportionately as to the portion of the Premises and to the length <br /> of time Premises is rendered untenantable and the minimum rent meanwhile shall be <br /> abated in whole, unless Within sixty (60) dais after said occurrence Landlord shall give <br /> ive <br /> Tenant written notice that it has elected not to reconstruct the Premises, in which event <br /> this lease and the tenancy hereby created shall. cease as of the date of said occurrence,the <br /> rent to be adjusted as of such date. As used in this section the term "Premises" shall be <br /> taken to exclude fixtures,, floor coverings, furniture and equipment owned by Tenant. <br /> If the premises are 100% destroyed either party may terminate this Lease. <br /> 26, 'PAYMENTS NOT TO BE WITHHELD <br /> Tenant shall not delay o'r withhold payments of rent, additional rent or any other charges <br /> under this Lease because of any dispute as to the amount or computation thereof, and <br /> 'Landlord shall. refund any overpayment found to be owing to Tenant upon the resolution <br /> of said dispute. <br /> 27, REPRESENTATIONS <br /> It is understood and agreed by Tenant that Landlord and its agents and employees have <br /> made no representations, warranties or promises with. respect to the premises or the <br /> making or entry into this Lease except as in this Lease expressly set forth and that no <br /> claim. for liability, or cause for ten-nination, shall be asserted by Tenant against Landlord <br /> for, and neither Landlord nor its agents and employees shall be liable by reason of any <br /> breach of any representations, warranties or promises not expressly stated in this Lease. <br />
