injury to persons, damage to property or to any other interest of Tenant sustained by
<br /> Tenant or any person claiming through Tenant resulting from any occurrence in. or upon
<br /> the Premises,, the building of which the Premises shall be a part or the Marketplace
<br /> including, but not limited to, such claims for damages resulting from: (a) any equipment
<br /> or appurtenances becoming out of repair; (b) the Premises, the building or the center
<br /> being out of repair; (c) injury or damage done or occasioned by wind, water, flooding,
<br /> freezing, fire, explosion, earthquake, excessive heat or cold, vandalism, riot or disorder or
<br /> other casualty- (d) any defect in or failure of plumbing, heating or air conditioning
<br /> equipment, electric wiring or installation thereof, gas, water, steam pipes, stairs, railing or
<br /> walls-- (e) broken glass; (f) the backing up of any sewer pipe or tub, washstand, water
<br /> closet, waste pipe, drain, cooling coil or any other pipe or tank in, upon or about such
<br /> building or Premises; (g) the escape of steam or hot water; (h) water, snow or ice being
<br /> upon or coming through the roof, skylight,trapdoor, stairs, walks or any other place upon
<br /> or near such building or Premises,- (1) the falling of any fixture, plaster or stucco" and 0)
<br /> any act, omission, or negligence of co-tenants or of other persons or occupants of said

<br /> building or of adjoining or contiguous buildings or of owners of adjacent or contiguous
<br /> property.
<br /> If any damage to the Premises or other property of Landlord results from any act or
<br /> neglect of Tenant, its agents or employees, Landlord may at its option repair such
<br /> damage, and Tenant shall promptly on demand reimburse Landlord for the cost thereof to
<br /> the extent same is not reimbursed to Landlord under Landlord's *insurance,, and such
<br /> reimbursement shall be deemed additional rent hereunder.
<br /> 22., INDEMNITY BY TENANT
<br /> Tenant shall indemnify Landlord and hold it harmless,from and against any and all
<br /> claims, actions, damages, liability and expense (*Including but not limited to, reasonable
<br /> attorney's fees) in connection With loss of life, personal "Injury or damage to property
<br /> arising from or out of the occupancy or use by Tenant of the Premises or by any part
<br /> thereof or any other part of Landlord's property, or occasioned wholly or in part by any
<br /> act or 'omissions of Tenant, his/her agents, contractors or employees or by reason of a
<br /> breach or default in the performance of Tenant's obligations hereunder unless caused by
<br /> Landlord's negligent or willful misconduct.
<br /> 21 LIMITATIONS ON LIABILITY
<br /> ,It is expressly understood and agreed by and between Lessor and Lessee that in the event
<br /> the Lessor is sued, for any reason, Lessee shall have no claim or demand of any kind or
<br /> character against Lessor by reason of such other suit. In the event Lessee makes such
<br /> claim or demand against Lessor by reason of such other suite, then this lease shall be
<br /> absolutely null and void and of no effect whatsoever.
