105 <br /> exceed the estimated cost of the work and possible damage <br /> but shall be not less than one thousand dollars nor more than <br /> fifty thousand dollars. Except in case of an emergency no <br /> permit for digging up or opening any town highway shall be <br /> approved or issued by the Department until copies of the-no- <br /> tices to public utility companies have been filed with the <br /> Department by the applicant for such permit. Except as pro- <br /> vided herein any person who digs up or makes an opening in <br /> a town highway without a permit or violates any other pro- <br /> visions of the section shall be punished by a fine or,not more <br /> than fifty dollars for the first offense and not less than fifty <br /> dollars nor more than one hundred dollars for any subsequent <br /> offense." <br /> 1-2 Objectives <br /> The fundamental objective is threefold: <br /> 1. To provide maximum protection to the Public through <br /> the orderly control of traffic moving onto and from a high- <br /> way. <br /> 2. To provide a uniform practice in the design and con- <br /> struction of entrances and exists. <br /> 3. To provide the necessary drainage. <br /> The following requirements are applicable to all com- <br /> mercial and industrial establishment, service areas and pri- <br /> vate residences having access to and/or through the right- <br /> of-way of a Town Highway, insofar as the requirements for <br /> drainage, geometric design, signing, type and quality of work- <br /> manship, <br /> manship, <br /> material used, and the work performed in the areas <br /> providing ingress and egress to said property are concerned. <br /> Any owner of abutting property desiring to gain access <br /> to a town highway shall do so only in strict accordance with <br /> the provisions of a permit issued by the Department. <br /> Written application must be made to secure such a per- <br /> mit from the Department through the Highway Surveyor <br /> having jurisdiction in the area. <br /> Location of the Highway Surveyors Office: Highway <br /> Dept., Meetinghouse Rd., Mashpee, Mass. 02649. <br /> 1-3 Applications <br /> Any owner of property abutting Town Highways shall, be- j <br /> fore beginning any construction, make written applications <br /> to the Highway Surveyor having jurisdiction in the area. <br /> 14 Driveways <br /> The application must be followed by a plan showing: <br /> . � I <br /> I <br />
