49 <br /> erected in said section of the PRC, together with the types <br /> of buildings to be erected therein with an indentification <br /> key. <br /> 9.586 Where the developer proposes to develop a PRC <br /> pursuant to a subdivision as to which approval of the Plan- <br /> ning Board is required under the Subdivision Control Law, <br /> the developer shall comply with Section 9.38 of this By-Law <br /> in lieu of.Section 9.585. <br /> 9.587 Approval of the Board of Appeals for use of land <br /> as a Planned Retirement Community under this Section 9.5 <br /> shall become void if the developer has not applied for a <br /> building permit with respect to a section of the land shown <br /> on the Master Site Development Plan within three (3) years <br /> i. from the date of such approval. Construction of the first <br /> section shall commence within one (1) year after all local, <br /> state and federal governmental permits and approvals with <br /> respect to the PRC have been obtained; provided, that there <br /> shall be excluded in computing said one (1) year period any <br /> period during which the granting of any such permit or <br /> approval is being appealed or otherwise 'contested. In the <br /> event construction of the PRC has not been substantially <br /> completed ten (10) years from the date that all such permits <br /> and approvals have been obtained, computed as set forth <br /> above, then the developer shall reapply for approval for the <br /> remaining undeveloped areas under this Section 9.5. <br /> 9.59 Miscellaneous <br /> 9.591 The Building Inspector may revoke a building <br /> permit issued under this By-Law in case the builder or devel- <br /> oper fails to conform to the plans and schedules as approved. <br /> 9.592 If any provisions of this Section 9.5 shall be found <br /> to conflict with any other provision of this By-Law, such <br /> conflict shall be resolved in favor of this Section 9.5. <br /> 9.593 If any section, subsection, or other portion of this <br /> Section 9.5 shall be adjudged invalid, the remainder of this <br /> Section 9.5 shall be deemed not to be affected thereby and <br /> shall continue to be in full force and effect. <br /> Submitted .by the Planning Board. <br /> Action: Amended as follows: <br /> a. Para 9.531, change to read: "Single family detached <br /> dwelling structures;" remainder of paragraph to be deleted. <br /> b. Insert new paragraph: "9.532 Structures consisting <br /> of not more than eight (8) attached dwelling units per <br /> structure;". <br />
