r
THE COMMONWEALTH OF MASSACHUSETTS
DEPARTMENT OF THE ATTORNEY GENERAL !
t > STATE HOUSE • BOSTON 02133,
"1 SVe" QQ.,
l'
ROBERT H. QUINN
ATTORNEY GENERAL
October 15, 1971
f
Mrs . Bernice L. Grant
Town Clerk v
Mashpee, Massachusetts
Dear Mrs. Grant:
I enclose the amendment to general by-laws adopted
under Article 12 and the amendment to zoning by-laws
adopted under Article 15 of the warrant for the special
town meeting held August 4, 1971 together with the map per-
raining to Article 15, with the approval of the Attorney
General endorsed thereon except that in Article 15 5 3 .6
the words "All land below the elevation of 12 feet above
mean sea level" are stricken and deleted therefrom.
The zoning map you submitted had no Flood Plain
Districts indicated thereon. A reference to mean sea level
without an accompaning map leaves a property owner at his
peril to determine if his land is in a flood plain district
and he may have to hire a civil engineer to ascertain if
he is within the district.
In order to include lands within your Flood Plain r
District, a future town meeting will have to adopt an amend-
ment to your by-laws and a map showing the boundary of said
district.
Very truly yours,
1
i
HENRY O'CONNELL, J .
Assistant Attorney G neral f
HFO'C:cf
Enclosure
h
