Planning Board voted at a Public Hearing held on September 19, 2007 4-0 to recommend <br /> approval. <br /> Motion made by Selectman Theresa Cook. <br /> Motion: I move Article 21 be voted as printed in the warrant, with the exception of the phrase, <br /> ".or take any other action relating thereto". <br /> Motion passes at 8:16 M. <br /> Article 22 <br /> To see if the Town will vote to amend the Zoning By-law by adding the following new <br /> Subsection 174-25.1-1.0 1) to the Section 174-25 Table of Use Regulations and specifying by the <br /> letters "SP" under all zoning district columns in said table that such use is allowed by Special <br /> Permit in all zoning districts: <br /> "0 1) Land-based wind energy conversion facilities, subject to approval of a Special Permit by <br /> the Planning Board under the provisions of Section 174-45.5." <br /> and by adding the following new Section 174-45.5: <br /> "1174-45.5. Land-Based Wind Energy Conversion Facilities (WECFs) <br /> A. Purpose and Intent. It is the express purpose of this section to <br /> accommodate distributed Wind Energy Conversion Facilities (WECFs) in <br /> appropriate land-based locations, while protecting public health, safety, <br /> welfare, the character of neighborhoods, property values, preservation of <br /> environmental, historical and scenic resources and minimizing adverse <br /> impacts of WECFs. All WECFs shall require issuance of a special permit <br /> by the Planning Board, acting as the Special Permit Granting Authority. <br /> This section is intended to be used in conjunction with other regulations <br /> adopted by the Town, including, but not limited to, historic district, special <br /> permit, conservation and other applicable by-laws and regulations <br /> designed to encourage appropriate land use and environmental protection. <br /> Further, it is the express intent of this section that any special permit <br /> hereunder granted runs with the land and that any subsequent owner of <br /> said land be bound by the terms and conditions of said special permit. <br /> B. Definitions. In addition to the definitions contained in Section 174-3, the <br /> following shall apply to Wind Energy Conversion Facilities: <br /> Clear Area - The distance from the lowest point of the blade tip to the <br /> ground. <br /> Height - Height is measured from the average grade at the base of the <br /> tower to the top of the fixed tower (moveable blades are not included). <br /> 34 <br />
