Final Study Report <br /> Mashpee Historic District <br /> Page 13 of 15 <br /> fI <br /> Justification of the Boundaries <br /> As delineated on the accompanying map, the proposed Mashpee Historic District extends along <br /> Main'Street from just west of Ashumet Road on the north to Cotuit Road on the south. It <br /> includes part of Lake Avenue extending towards Mashpee Pond on the north side.of Main Street, <br /> a short section of Great Neck Road North that run south from Main Street. <br /> The district boundaries are drawn to include historic residential, civic, commercial, and <br /> institutional buildings and sites along both sides of the primary roads in Mashpee center, as well <br /> as to include open space that is primarily town-owned (and including a number of historic <br /> building and cultural sites) and that enhances the rural setting of the buildings. These boundaries <br /> capture the heart of Mashpee's traditional town center. While some modem, late 2e century <br /> buildings are encompassed in the district, the ends of the district on Main Street and Great Road <br /> North are drawn where higher proportions of recent buildings begin. The boundaries are based <br /> on visibility and are intended to include buildings and property that can be seen from the public <br /> road. Wherever possible, the boundary follows lot lines. In certain sections where lots are large, <br /> a line of convenience 150 ft from the side line of the road layout is used. <br /> Bylaw Recommendations <br /> The LHDSC was developed and is recommending the draft bylaw based on the example in the <br /> MHC's Establishing a Local Historic District handbook, on samples collected, and on a i <br /> determination of what is appropriate for the Mashpee Historic District. The LHDSC is made up <br /> of representatives of the town, including the Mashpee Historical Commission, the Mashpee <br /> Wampanoag Tribe, residents, and an architect. It formerly included a representative from the <br /> local Board of Realtors, for whom a replacement could not be found upon his retirement. The <br /> draft and final bylaw has been reviewed and approved by the Town's legal counsel. . <br /> j <br /> The LHDSC is recommending this bylaw as meeting both the requirements of MGL Chapter i <br /> 40C and the unique characteristics of the Mashpee Historic District. The Mashpee Historic <br /> District Bylaw proposes alternate nominating organizations to those specified in Chapter 40C in <br /> order to accurately reflect Mashpee's historical character and the composition of the town's <br /> heritage stewardship. Section 110-8 Exclusions of the bylaw exempts certain work from review <br /> by the local historic district commission. Please refer to the bylaw for the complete information <br /> on each exclusion item. <br /> The appeals process set for in Section 110-6.N under Procedures for review of applications states <br /> that, <br /> A PERSON AGGRIEVED by a determination of the COMMISSION may, within twenty <br /> days of the issuance of a CERTIFICATE or disapproval, file a written request with the <br /> COMMISION for a review by a person or persons of competence and experience in such <br /> matters, acting as arbitrator and designated by the regional planning agency. The finding of <br /> the person or persons making such review shall be filed with the Town Clerk within forty- <br /> five (45) days after the request, and shall be binding on the applicant and the <br />
