Motion-, I move Article 22 be voted as printed in the warrant, except for the phrase "or take any <br /> other action relating thereto". <br /> Motion made to dispense with reading of Article 22.. <br /> Motion to dispense with reading of Article 22 passes at 8:52 PM <br /> Motion passes unanimously at 8:51 PM <br /> Article 23 <br /> To see if the Town will vote to amend the zoning bylaw by amending Section 4,74-24.C.9. (g) to <br /> read as follows: <br /> "(g)A modification under (b) or (c) above may expand the land area covered by said special <br /> permit; provided that all uses, dimensions and other aspects of proposed development within <br /> the expanded area are in conformance with the provisions of the zoning bylaw applicable to <br /> the land at the time of approval of said modification, and provided that the original special <br /> permit granting authority has authority to approve said proposed uses and development <br /> under the provisions of the zoning bylaw applicable to the expanded land area at the time of <br /> approval of said modification, except that, for a cluster subdivision or multi-family <br /> development previously approved by the Planning Board, the Board may approve a <br /> modification expanding the land area of the project under the provisions of the zoning by- <br /> law applicable to the original special permit approval, provided that there is no increase in <br /> the number of dwelling units allowed by said special permit nor any decrease in the area of <br /> protected open space." <br /> or take any other action relating thereto. <br /> Submitted by the Planning Board <br /> Explanation-, This article would allow the Planning Board to expand the land area covered by <br /> an existing cluster subdivision or multi-family project under the same zoning rules as applied to <br /> their original approval of the special permit for the project, provided that the change does not <br /> increase the number of residential units permitted under the existing special permit. <br /> The Board of Selectmen and the Finance Committee recommend approval. <br /> Planning Board voted at a Public Hearing held on October 5, 2005 4-0 to recommend <br /> approval. <br /> Motion made by John Cahalane. <br /> Motion.- I move Article 23 be voted as printed in the warrant, except for the phrase "or take any <br /> other action relating thereto". <br /> 0 <br /> Motion made to dispense with reading of Article 23. <br /> Motion to dispense with reading of Article 21 passes, at 84,,52 PMO <br /> 23 <br />
