Motion: I move the Town vote to adopt Section 298 of Chapter 149 of the Acts of 2004, which allows the town to replace the Cape Cod Open Space Land Acquisition Program with the Community Preservation Act and dedicate the three per cent property tax surcharge currently being assessed through fiscal year 20�20, along with state matching funds that will be available to the town under the Community Preservation Act, to a special "Community Preservation Fund" that may be appropriated and spent for certain open space, historic resources and affordable housing purposes, effective for the fiscal year beginning on July 1, 2005. Motion passes by majority vote at 9:07 p.m. Article 28 To see if the Town will vote to amend the Mashpee Code by striking the last sentence of Article 1, §40-1 (B) and inserting in place thereof the following language: "The Selectmen may insert in the warrant for the Annual, Town Meetings all articles and/ or petitions signed by ten (10) or more legal voters which shall have been delivered to the Office of Selectmen,1' or take any other action relating thereto. Submitted by the Board of Selectmen Explanation: This change will require all petition articles to be submitted directly to the Office of Selectmen in order to streamline the Town Meeting Warrant process. Motion: I move Article 28 be made to indefinitely postpone Motion passes at 9:08 p.m. Article 29 To see if the Town will vote to amend Mashpee Code, Section 27-3 by increasing the fee for Underground Storage from $2.50 to $25.00, or take any other action relating thereto. Submitted by the Town Clerk Explanation: Massachusetts General Laws, Chapter 148, Section 13, authorizes the town to set the fees for underground storage of fuel. Currently, the fees as outlined in section 27-3 only allows the Town Clerk to charge $2.50 for an underground storage permit. 17
