Motion to dispense with reading of Article 39 passes at 9:34 p.m. Motion made by Kenneth Marsters. Motion: I move Article 39 be voted as printed in the warrant with the exception of the phrase, "or take any other action relating thereto". Motion passes unanimously at 9:34 pem. Article 40 To see if the Town will vote to amend the Zoning By-law by amending the Section. 174-31 "Town of Mas,hpee — Land Space Requirements Table" by adding a reference to footnote 21 to -1 the heading of the "Maximum Building Height" column, with said footnote to read as follows" "21 Except that hotels and motels (and not other uses) approved by the Planning Board under the provisions of Section 174-45 may be increased to 3 stories and 45 feet, if approved by the Board, provided that there is adequate access for Fire Department vehicles and equipment and that all Fire Protection Construction Documents required by 780 CMS. Subsection 903.1.1 of the Massachusetts State Building Code, have been submitted to the Planning Board and Fire Department as part of the special permit application and the Board is satisfied that the standards of said Subsection will be met.", or take any other action relating thereto. Submitted by Planning Board Explanation: This article would allow the Planning Board to authorize an increase in height for a hotel or motel as part of the special permit required for such projects. Adequate access for fire equipment would be required, and all fire protection documents required for such projects by the state building code would have to be provided as part of the special permit application materials.
