Motion to dispense with reading of Article 39 passes at 9:34 p.m. <br /> Motion made by Kenneth Marsters. <br /> Motion: I move Article 39 be voted as printed in the warrant with the exception of the phrase, <br /> "or take any other action relating thereto". <br /> Motion passes unanimously at 9:34 pem. <br /> Article 40 <br /> To see if the Town will vote to amend the Zoning By-law by amending the Section. 174-31 <br /> "Town of Mas,hpee — Land Space Requirements Table" by adding a reference to footnote 21 to <br /> -1 <br /> the heading of the "Maximum Building Height" column, with said footnote to read as follows" <br /> "21 Except that hotels and motels (and not other uses) approved by the Planning Board under the <br /> provisions of Section 174-45 may be increased to 3 stories and 45 feet, if approved by the Board, <br /> provided that there is adequate access for Fire Department vehicles and equipment and that all <br /> Fire Protection Construction Documents required by 780 CMS. Subsection 903.1.1 of the <br /> Massachusetts State Building Code, have been submitted to the Planning Board and Fire <br /> Department as part of the special permit application and the Board is satisfied that the standards <br /> of said Subsection will be met.", <br /> or take any other action relating thereto. <br /> Submitted by Planning Board <br /> Explanation: This article would allow the Planning Board to authorize an increase in height for <br /> a hotel or motel as part of the special permit required for such projects. Adequate access for fire <br /> equipment would be required, and all fire protection documents required for such projects by the <br /> state building code would have to be provided as part of the special permit application materials. <br /> Motion made to dispense with the reading of Article 40 made at 9:34 p.m., <br /> Motion to dispense with reading of Article 40 passes, at 9:34 p.m. <br /> Motion made by Don Myers. <br /> Motion: I move Article 40 be voted as printed in the warrant with the exception of the phrase, <br /> "or take any other action relating thereto". <br /> Planning Board voted at a Public Hearing held on September 28, 2004 5-0 to, recommend <br /> approval. <br /> Moderator declares motion passes by a 2/3rds vote at 9:35 p.m. <br /> 28 <br />
