Motion to extend To�wn Meeting passes at 10:03 p.m. <br /> Article 26 <br /> To see if the Town will vote to amend Chapter 172 of the Mashpee Code by deleting Section 172-5E and <br /> inserting in place thereof the following-. <br /> 172-5E. No such application shall be deemed complete until all other applicable local and state permits and <br /> licenses for the proposed project have been applied for. <br /> or take any other action relating thereto. <br /> Submitted by the Conservation Commission <br /> Explanation: This language will clarify the Bylaw regarding holding up issuance of Orders of Conditions <br /> (OoC) for approval from other Town Boards such as Board of Health and Board of Appeals. There is a State <br /> time limit under the Wetlands Protection Act Regulations which conflicts with Conservation holding up OoC <br /> pending Board of Appeals approval. The Wetlands Protection Act Regulations 310 CMR 10�.00 require <br /> issuance of the OoC within 21 days from the close of the hearing. This will expedite the Notice of Intent <br /> process considerably for applicants going before the Conservation Commission. <br /> Motion made by David Levelille. <br /> Motion: I move Article 26 be voted as printed in the warrant, with the exception of the phrase, "or take any <br /> other action relating thereto". <br /> Motion passes at 10:04 p.m. <br /> Article 27 <br /> To see if the Town will vote to amend Chapter 172 of the Mashpee Code by renumbering Subsection 2 of <br /> Section 7.A as Subsection 3 and relettering and renumbering subsection references therein as shown on a <br /> proposed amended subsection on file in the O�ffice of the Town Clerk, or take any other action relating thereto. <br /> Submitted by the Conservation Commission <br /> Explanation: The subsection in question was unanimously passed at last October's Town Meeting and was <br /> approved by the Attorney General. However, it was erroneously numbered as Subsection 2,when there already <br /> was a Subsection 2. It should have been numbered as Subsection 3. The amendment proposed by this article <br /> includes additional relettering and renumbering of the renumbered Subsection 3 to make it consistent with the <br /> pre-existing numbering/lettering.
