Submitted by the Board of Selectmen <br /> and Water District Commission <br /> Explanation: This article has been submitted at the request of the Mashpee Water District to create a new <br /> Groundwater Protection District to protect the "Zone 11"recharge area of the District's new "Mashpee Village" <br /> well. <br /> Planning Board voted at a Public Hearing held on April 18, 2001,4-0 for approval. <br /> Motion made by George Green. <br /> Motion: I move Article 29 be voted as printed in the warrant, with the exception of the phrase, "or take any <br /> other action relating thereto". <br /> Motion made to dispense with reading of article. <br /> Motion to dispense with reading of article passes at 10:05 p.m. <br /> Motion made to amend to indefinitely postpone at 10:15 p.m. <br /> Motion to 'Indefinitely postpone defeated at 10:17 p.m. <br /> Motion i's defeated 127-76 at 10:22 p.m. <br /> Article 30 <br /> To see if the Town will vote to authorize the Selectmen to acquire, by purchase or otherwise, for conservation <br /> and passive recreation purposes, all or a portion of those parcels of land identified on the FY2000 Mashpee <br /> Assessors' Maps as Map 73, Blocks 7 and 11, consisting of 17.89 acres, more or less, located along the <br /> Quashnet River north and south of Route 151 and shown on a"Plan of Land in Mashp,ee, Mass. surveyed for <br /> Marion H. Collins, Carleton H. Collins & Erdine C. Henriksen", dated June 17, 19721 by John 0. Henriksen, <br /> RLS, to be held in the care and custody of the Conservation Commission pursuant to Mass. General Laws <br /> Chapter 40, Section 8C- and further, to see if the Town will vote to appropriate and transfer from the Land <br /> Bank Fund established by the Town under the provisions of Chapter 293 of the Acts of 1998 (An Act Relative <br /> to the Establishment of the Cape Cod Open Space Land Acquisition Program), or borrow, $70,000 for such <br /> purpose, including expenses incidental and related thereto, and that the Treasurer, with the approval of the <br /> Selectmen') be authorized to borrow $70,000 or any other sum under and pursuant to Chapter 44, Sections 7 <br /> and 8C and, if applicable, Chapter 40�, Section 8C of the Mass. General laws, or any other enabling authority, <br /> and to issuebonds or notes of the Town therefor; with said borrowing to be repaid with funds from the Land <br /> Bank Fund established by the Town under the provisions of Chapter 293 of the Acts of 1998; and further, to <br /> see if the Town will vote to raise and appropriate or transfer from available funds $500 to the Issuance of Debt <br /> Account; and further, to see if the Town will authorize the Board of Selectmen and/or Conservation <br /> Commission to apply for and accept Federal, State and/or County grants, including reimbursement under <br /> Chapter 132A, Section I I of the Mass. General Laws, the "Self-Help Act", to be applied by the Town toward <br /> the financing of this purchase, and to enter into contracts or agreements with Federal, State and/or County <br /> agencies, private conservation trusts or other entities or persons in connection with the acquisition of all or a <br /> portion of such land and its preservation for conservation and passive recreation purposes, including <br /> enforcement of conservation restrictions on the land; and finally, to see if the Town will authorize the <br /> Conservation Commission and the Board of Selectmen to enter into agreements and execute any and all <br /> instruments as may be necessary on behalf of the Town to effectuate said acquisition or preservation, or take <br /> any other action relating thereto�. <br /> 31 <br />
