Submitted by Open Space Committee <br /> Explanation: This article would authorize the Board of Selectmen to purchase, on behalf of the Conservation <br /> Commission, a portion of a 17.89 acre parcel located along the Quashnet River north and south of Route 151 <br /> and adjacent to existing Town conservation land, the High School site and private open space at Mashpee <br /> Village and the Quashnet Valley Country Club. The area is in the Mashpee National Wildlife Refuge and the <br /> recharge area of Waquoit Bay and is recommended as a high priority acquisition by the Comprehensive Plan. <br /> The purchase would be paid for with Land Bank funds. The land will be purchased by the Orenda Wildlife <br /> Land Trust, from which it is intended that the Town will buy the fee interest in the 13.93 acre portion south of <br /> Route 151 subject to a conservation restriction which is to be purchased by the Massachusetts Division of <br /> Fisheries&Wildlife. <br /> Motion made by David Leveille. <br /> Motion: I move the Town vote to authorize the Selectmen to acquire, by purchase or otherwise, for <br /> conservation and passive recreation purposes, all or a portion of those parcels of land identified on.the FY2000 <br /> Mashpee Assessors' maps as Map 73, Blocks 7 and 11, consisting of 1.7.89 acres, more or less, located along <br /> the Quashnet River North and South of Route 151 and shown on a"plan of land in Mashpee, Mass. surveyed <br /> for Marion H. Collins, Carleton H. Collins & Erdine C. Henriksen"., dated June 17, 1972� by John 0. <br /> Henriksen, RLS, to be held in the care and custody of the Conservation Commission pursuant to Massachusetts <br /> General Laws Chapter 40, Section 8C- and further vote to appropriate and transfer from the Land Bank Fund <br /> established by the Town under the provisions of Chapter 293 of the Acts of 199�8 (an act relative to the <br /> establishment of the Cape Cod Open Space Land Acquisition Program) $70,000 for said purpose, and further, <br /> to authorize the Board, of Selectmen to apply for and accept federal, state and/or county grants, including <br /> reimbursement under Chapter 132A, Section I I of the Massachusetts General Laws, the"Self-Help Act", to be <br /> applied by the Town toward the fmancing of this acquisition, and to enter into contracts or agreements with <br /> federal, state and/or county agencies, private conservation trusts or other entities or persons in connection with <br /> the acquisition of all or a portion of such land and its preservation fo�r conservation and passive recreation <br /> purposes, including enforcement of conservation restrictions on the land; and finally, to authorize the <br /> Conservation Commission and the Board of Selectmen to enter into agreements and execute any and all <br /> instruments as may be necessary on behalf of the Town to effectuate said acquisition and preservation. <br /> Motion made to dispense with reading of article. <br /> Motion to dispense with reading of article passes at 10�:22 p.m. <br /> Motion passes unanimously at 10:25. <br /> Article 31 <br /> To see if the Town will vote to authorize the Selectmen and/or Conservation Commission to grant a <br /> conservation restriction and/o�r management easement on that parcel of land identified on the 1999 Mashpee <br /> Assessors' Maps as Map 9�8, Block 1, consisting of 12.37 acres, more or less, located between Holland Mill <br /> Road, Old Ockway Road and "Coombs Avenue" and shown on a "Plan of Land in Mashpee, Mass. prepared <br /> for Heirs of Maurice F. Greaney"', dated October 6, 1989, by Schofield Brothers, Inc. Registered Land <br /> Surveyors, which has been purchased and held in the care and custody of the Conservation Commission <br /> pursuant to Mass. General Laws Chapter 40, Section 8C under the provisions of the vote under Article 23 of <br /> the warrant for the October 2, 2000 Annual Town Meeting, to the Commonwealth of Massachusetts Division <br /> of Fisheries & Wildlife under terms and for compensation which are agreeable to the Board of Selectmen and <br /> Conservation Commission, and to enter into contracts or agreements with the Massachusetts Division of <br /> Fisheries & Wildlife in connection with said restriction and/or easement and execute any and all instruments as <br /> may be necessary on behalf of the Town to effectuate said restriction and/or easement; and finally, to authorize <br /> the Selectmen to petition the General Court for special legislation authorizing the Town to enter into said <br /> 32 <br />
