Motion made by Ernest Virgilio: <br /> Motion: I move that the article be moved as written <br /> Motion made to indefinitely postpone made. <br /> Motion to indefinlitely postpone defeated at 11:06 P.M. <br /> Motion passes by 2/3rds,vote at 11:07 p.m. <br /> Article 42 <br /> To see if the Town will vote to amend the zoningbylaw by amending Subsection 174-5.E. to read as fo�llows: <br /> "E. The IC Overlay District shall include those parcels shown on the 1999 Mashpee Assessors' Maps as Map <br /> 81, Blocks 18 and 21, and Map 88, Blocks 2, 19, 20, 23, 34, 36, 37, 41, 42, 80, 81, 82 and 89, as well as those <br /> portions of Map 81, Blocks 17 and 19 which are located in the 1-1 Industrial Zone and that portion of Map 54, <br /> Block 5 lying within 625 feet of the center line of Route 28."; <br /> amending the first paragraph of Section 174-24.H. to replace the phrase "Provided that there shall be no direct <br /> driveway access to Route 28" with the phrase "provided that there shall be no direct driveway access from the <br /> parcel on which said use is located, or from said parcel across any other parcel, to Route 28 which was not in <br /> existence on January 1, 2001"; <br /> amending Subsection 174-24.H.(2) to add the term"major household appliances,"after the term furniture,"-, <br /> and amending Subsection 174-24.1-1.(4) to replace the phrase "Retail establishments which will not generate <br /> greater than 300 peak daily vehicle trips per acre of total site area, per day" with the phrase "Other retail <br /> establishments which will not generate greater than 300 annual average vehicle trip ends on any day of the week <br /> per acre of total site are"; <br /> or take any other action related thereto. <br /> Submitted by Petition <br /> Explanation: This article would expand the boundaries of the I-,C Overlay District, which allows certain low- <br /> impact retail uses in a portion of the I-I Industrial zone, to include Map 88, Block 2 (the "Summerfield ParW' <br /> business condominium development) and the portion of Map 54, Block 5 on which the former Augat building <br /> and its parking area are located, would allow such uses to utilize existing driveway access to Route 28 (these <br /> uses in 1-1 are currently not allowed any driveway access to Rout 28), would add the sale of major household <br /> appliances (stoves, refrigerators, washers, dryers and similar large items)to the list of items allowed to be sold at <br /> retail and would clarify that other retail establishments which generate no more than 300 vehicle trips per acre <br /> per day are allowed in.addition to those specifically listed in the bylaw. <br /> Planning Board voted at a Public Hearing held April 18, 20�01 4-0 for approval. <br /> Motion to be made by Petitioner. <br /> Motion made to 'Indefinitely postpone. <br /> Motion to indefinitely postpone passes at 11:10 p.m. <br /> Town Meeting adjourned at 11:10 P.M. <br /> 40 <br />
