Article 38 To see if the Town will vote to authorize and empower the Board of Selectmen to prepare a plan laying out and defining Fir Court and to accomplish said purpose and for expenses incidental and related thereto, the Town vote to raise and appropriate or transfer from available funds for appropriation a sum of money to the Fir Court Roadways Account and to raise said appropriation, the Treasurer with the approval of the Board of Selectmen be authorized to borrow at one time, or from time to time, a sum of money under and pursuant to Chapter 44, Section 7 or 8 or any other enabling authority and to issue bonds and notes of the Town therefore, and further, to see if the Town will vote to raise and appropriate or transfer from available funds a sum of money to the Fir Court Roadways Account to provide interest and debt issuance expenses, or take any other action relating thereto. Motion: I move the Town vote to authorize and empower the Board of Selectmen to prepare a plan laying out and defining Fir Court and to accomplish said purpose and for expenses incidental and related thereto the Town vote to raise and appropriate $5,000 to the Fir Court Roadways Account. Motion passes at 10:56 p.m. Article 40 To see if the Town will vote to delete the Words, "and Public Works D�irector" in Article XIV (Natural Resources Management Committee), § 5-55.A. in Chapter 5 of the Code of the Town of Mashp,ee. Submitted by Petition Explanation: This change will facilitate meeting committee quorum requirements by making provision for an alternate member to represent the Public Works Department if the Director is not available. Motion made by Edward Baker. Motion: I move the Town vote to delete the words "and Public Works Director" in Article XfV (Natural Resource Management Committee), § 5-,55.A. in Chapter 5 of the Code of Town of Mashpee. Motion passes at 10:59 p.m. Article 41 To see if the Town will vote to amend the zoning bylaw by amending the zoning map to re-designate the parcel shown, on. the 2000 Mashpee Assessors' Maps as Map 81, Block 85 from, 1-1 Industrial to C-2 Commercial, or take any other action related thereto. Submitted by Petition Explanation-, This article would change the zoning on the Mills residence on Route 28 adjacent to Madaket Place from I-I Industrial, to C-2 Commercial, allowing retail uses of the property. Planning Board voted at a Public Hearing held on April 18, 20014-0 not to support this article. 39
