Article 14 <br /> To see if the Town will vote that the parcel of land located off of Falmouth Road adjacent to real <br /> property of the South Cape Resort & Club Condominium, identified on the plan entitled South <br /> Cape Resort & Club Condominium I (Site Plan), Mashpee, Massachusetts, dated June 1, 19�82, <br /> prepared by Norwood Engineering Company, Inc., as lot 51, which was acquired by the Town <br /> through tax foreclosure, not be held for conservation purposes and to authorize the Board of <br /> Selectmen to convey all, or a portion, of said lot, or any interest therein, as the Board of <br /> Selectmen may deem to be in the best interest of the Town, or take any other action relating <br /> thereto. <br /> Submitted by the Board of Selectmen <br /> Explanation: This Article requests Town Meeting authorization to remove from conservation <br /> use and to sell, convey or otherwise dispose of the Town's interest in a portion of a parcel of land <br /> located to the rear of 950 Falmouth Road which was acquired by the Town through the tax <br /> foreclosure process. The Town has been negotiating with the FDIC and Southcape Resort & <br /> Club Condominium representatives in an effort to resolve property right and restriction issues <br /> relating to the disposition by the Town of an abutting tax foreclosed parcel located at 966 <br /> Falmouth Road to the May Institute for development of a group home for disabled individuals <br /> and a community greenhouse/garden. The Town Meeting approved the disposition of the 966 <br /> Falmouth Road parcel at the May 2004 Annual Town, Meeting. This proposed Article will <br /> provide the authority necessary for the Selectmen to consider an exchange of interests in the <br /> subject parcels of land to clear title and allow the May Institute project to move forward without <br /> further litigation. <br /> The Board of Selectmen recommends approval by a vote of 4-0. <br /> The Finance Committee recommends approval. <br /> Motion made by Selectman John Cahalane. <br /> Motion: I move the Town vote that the parcel of land located o�ff of Falmouth Road adjacent to <br /> real property of the South Cape Resort & Club Condominium, identified on the plan entitled <br /> South Cape Resort & Club Condominium I (Site Plan)�, Mashpee, Massachusetts, dated June 1, <br /> 1982, prepared by Norwood Engineering Company, Inc., as lot 5, which was acquired by the <br /> Town through tax foreclosure, not be held for conservation purposes and to authorize the Board <br /> of Selectmen to convey all, or a portion, of said lot, or any interest therein, as the Board of <br /> Selectmen may deem to be in the best interest of the Town. <br /> Motion passes unanimously at unanimously at 9:25PM. <br /> Article 15 <br /> To see if the Town will vote to reauthorize the Sewer Commission Facilities Plan Account, or <br /> take any other action relating thereto. <br /> Submitted by the Sewer Commission <br /> 22 <br />
