Article 15
To see if the Town. will vote to amend the provisions of Mashpee Zoning Bylaw, Article XVI,
Section 174-95 by adding the following sentence thereto: "The Board of Appeals shall
furthermore have and exercise any and all powers formerly vested in the Mashpee Subdivision
Board of Appeals by the provisions of M.G.L. c.41, §817, or any other enabling authority", or
take any other action relating thereto.
Submitted by the Charter Bylaw Review Committee
Explanation: Pursuant to its authority to review and revise provisions of the Mashpee Bylaws
under the mandate of the Mashpee Home Rule Charter Article 8, Section 85(Section A), the
Bylaw Review Committee deemed it appropriate to recommend the deletion of General Bylaw,
Part I — Administrative Legislation, Article XV, Sections 5-58 through 5-61, relating to the
Subdivision Board of Appeals. A Subdivision Board of Appeals, as authorized by said General
Bylaw, had not been appointed or engaged in any substantive activity in the Town of Mashpee
for many years and the statutory duties and responsibilities of a Subdivision Board of Appeals, as
set forth in the provisions of General Laws Chapter 41 are consistent with and, in many
instances, duplicative of the statutory duties and powers of the Zoning Board of Appeals
constituted pursuant to General Laws Chapter 4 A. Accordingly, for the purposes of
administrative efficiency and elimination of redundant authority regarding land use regulation
matters, the Bylaw Review Committee deemed it prudent and in the best interest of the Town to
eliminate the requirement for a Subdivision Board of Appeals. The proposed Amendment to
Zoning Bylaw, Section 174-95 specifically recites that the Zoning Board of Appeals shall have
and exercise any and all powers formerly vested in the Mashpee Subdivision Board of Appeals.
