(a) Chapter 3 of Part 1, appointed Boards & Commissions, Article IX, Mashpee Cable and <br /> Advanced Technology Advisory Board, § 3-33, to be revised to read as current General <br /> By-Law, §5-48, retaining 7 members on the Board; <br /> (b) The provisions of current General Bylaw, Part 1, Chapter 5, Article XV, §§5-58 through <br /> 5-61, Subdivision Board of Appeals shall be retained, in its entirety, and incorporated <br /> into the proposed General By-Law, Part 1, Chapter 3, as Article III, §§3­44 through 3- <br /> 47; and <br /> (c) Part 1,, Chapter 5, Article IV, Section 5-25 should reference the provisions of§5-2O rather <br /> than §27-12. <br /> (d) Part 1, Chapter 2, Article 1, §2-1 D .-firstline, to be revised to read "The Selectmen may <br /> insert in said warrant...- rather than "shall" insert. <br /> (e) Part 1, Chapter 6, Article Viii-"Capital Improvement Committee and Program," §6-13: <br /> replace the references to "$100,000 with "$30,000". <br /> Motion made to 'Indefinitely postpone at 9:33 p.m. <br /> Motion to indefinitely postpone passes at 9:35 p.m. <br /> Article 15 <br /> To see if the Town. will vote to amend the provisions of Mashpee Zoning Bylaw, Article XVI, <br /> Section 174-95 by adding the following sentence thereto: "The Board of Appeals shall <br /> furthermore have and exercise any and all powers formerly vested in the Mashpee Subdivision <br /> Board of Appeals by the provisions of M.G.L. c.41, §817, or any other enabling authority", or <br /> take any other action relating thereto. <br /> Submitted by the Charter Bylaw Review Committee <br /> Explanation: Pursuant to its authority to review and revise provisions of the Mashpee Bylaws <br /> under the mandate of the Mashpee Home Rule Charter Article 8, Section 8­5(Section A), the <br /> Bylaw Review Committee deemed it appropriate to recommend the deletion of General Bylaw, <br /> Part I — Administrative Legislation, Article XV, Sections 5-58 through 5-61, relating to the <br /> Subdivision Board of Appeals. A Subdivision Board of Appeals, as authorized by said General <br /> Bylaw, had not been appointed or engaged in any substantive activity in the Town of Mashp�ee <br /> for many years and the statutory duties and responsibilities of a Subdivision Board of Appeals, as <br /> set forth in the provisions of General Laws Chapter 41 are consistent with and, in many <br /> instances, duplicative of the statutory duties and powers of the Zoning Board of Appeals <br /> constituted pursuant to General Laws Chapter 4 A. Accordingly, for the purposes of <br /> administrative efficiency and elimination of redundant authority regarding land use regulation <br /> matters, the Bylaw Review Committee deemed it prudent and in the best interest of the Town to <br /> eliminate the requirement for a Subdivision Board of Appeals. The proposed Amendment to <br /> Zoning Bylaw, Section 174-95 specifically recites that the Zoning Board of Appeals shall have <br /> and exercise any and all powers formerly vested in the Mashpee Subdivision Board of Appeals. <br /> 50 <br />
