<br /> Motion.- I move the Town vote to authorize the Selectmen to acquire, by purchase or otherwise,
<br /> for the purposes identified in Chapter 293 of the Acts, of 1998 (An Act Relative to the
<br /> Establishment of the Cape Cod Open Space Land Acquisition Program), all or a portion of those
<br /> parcels of land identified on the 2 Iashpee Assessors' Maps as Map 28, Block 3, Map 36,
<br /> Block 10 and Map 36, Block 80, consisting of 9 acres, more or less, located between Attaquin
<br /> Park, Main Street (Route 130) and Collins Lane, along with those portions of any adjacent ways
<br /> which are appurtenant to said parcel, said parcels also being those described in deeds recorded at
<br /> the Barnstable County Registry of Deeds at Book 14758, Page 8 and Book 14743, Page 183; and
<br /> further, the Town vote to appropriate $1,450,000 for such purpose, including expenses incidental
<br /> and related thereto, and that to raise such appropriation, the Treasurer, with the approval of the
<br /> Selectmen, be authorized to borrow $1,450,000 under and pursuant to Chapter 44, Sections 7 and
<br /> 8C and, if applicable, Chapter 40, section 8C of the General laws, or any other enabling
<br /> authority, and to issue bonds or notes of the Town therefor, with said borrowing to be repaid
<br /> with funds from the Land Bank Fund established by the Town under the provisions of Chapter
<br /> 293 of the Acts, of 1998 (An Act Relative to the Establishment of the Cape Cod Open Space
<br /> Land Acquisition Program); and further the Town vote to transfer $29,650 from the Land Bank
<br /> Fund to the Issuance of Debt Account; and further, vote to authorize the Board of Selectmen to
<br /> apply for and accept Federal, State and/ or County grants, to be applied by the Town toward the
<br /> financing of this purchase, and to enter into contracts or agreements with Federal, State and / or
<br /> County agencies, private conservation trusts or other entities or persons in connection with the
<br /> purchase of all or a portion of such land and its preservation and management for the purposes
<br /> identified in Chapter 293 of the Acts of 1998, including conveyance and enforcement of a
<br /> perpetual conservation restriction on the land in accordance with Chapter 184 of the General
<br /> Laws as required by the provisions of Chapter 293, section 10 of the Acts of 1998 as, amended,
<br /> to an organization qualified and willing to hold such a restriction; and finally, to authorize the
<br /> Board of Selectmen to enter into agreements and execute any and all instruments as may be
<br /> necessary on behalf of the Town to effectuate said acquisition, sale, transfer or preservation.

<br /> on the 2004 Mashpee Assessors' Maps as Map 6,7, Blocks 76 and 77, and Map 68, Blocks 104
<br /> and 105, consisting of 16 acres, more or less, bounded by Old Barnstable Road, Old Falmouth
<br /> Road, Great Neck Road, Central Road and Bates Road, said parcels also being those described in
<br /> the deeds recorded at the Barnstable County Registry of Deeds at Book 3380, Page 311 and
