<br /> To see if the Town will vote to authorize the Selectmen to acquire, by purchase or otherwise, for
<br /> the purposes identified in Chapter 293 of the Acts of 1998 (An Act Relative to the Establishment
<br /> of the Cape Cod Open Space Land Acquisition Program), all or a portion of those parcels of land
<br /> identified on the 2004 Mashpee Assessors' Maps as Map 28, Block 3, Map 36, Block 10 and
<br /> Map 36, Block 80, consisting of 9 acres, more or less, located between Attaquin Park, Main
<br /> Street (Route 130) and Collins Lane, along with those portions of any adjacent ways which are
<br /> appurtenant to said parcel, said parcels also being those described in deeds recorded at the
<br /> Barnstable County Registry of Deeds at Book 14758, Page 8 and Book 14743, Page 183; and
<br /> further, to see if the Town will vote to raise and appropriate, or transfer from available funds,
<br /> $1,450,000 for such purpose, including expenses incidental and related thereto, and to raise such
<br /> appropriation, the Treasurer, with the approval of the Selectmen, be authorized to borrow
<br /> $1,450,000 or any other sum under and pursuant to Chapter 44, Sections 7 and 8C and, if
<br /> applicable, Chapter 40, section 8C of the General laws, or any other enabling authority, and to
<br /> issue bonds or notes of the Town therefor, with said borrowing to be repaid with funds from the
<br /> Land Bank Fund established by the Town under the provisions of Chapter 293 of the Acts of
<br /> 1998 (An Act Relative to the Establishment of the Cape Cod Open Space Land Acquisition
<br /> Program); and further, vote to raise and appropriate $29,650 to the Issuance of Debt Account,*
<br /> and further, to authorize the Board of Selectmen to apply for and accept Federal, State and / or
<br /> County grants to be applied by the Town toward the financing of this purchase, and to enter into
<br /> contracts or agreements with Federal, State and / or County agencies, private conservation trusts
<br /> or other entities or persons in connection with the purchase of all or a portion of such land and its
<br /> preservation and management for the purposes identified in Chapter 293 of the Acts of 1998,
<br /> including conveyance and enforcement of a perpetual conservation restriction on the land in
<br /> accordance with Chapter 184 of the General Laws as required by the provisions of Chapter 293,
<br /> section 10 of the Acts of 1998 as amended, to an organization qualified and willing to hold such
<br /> a restriction; and finally, to authorize the Board of Selectmen to enter into agreements and
<br /> execute any and all instruments as may be necessary on behalf of the Town to effectuate said
<br /> acquisition, sale, transfer or preservation; or take any other action relating thereto.

<br /> Explanation: This article would authorize the Board of Selectmen to purchase, for the purposes
<br /> allowed by the Land Bank Act, 3.8 acres on the north side of Main Street (Route 130) which is
<br /> located between the Flume Restaurant, Attaquin Park and Dunkin' Donuts, and 5.2 acres on the
<br /> south side of Main Street (the former Attaquin Hotel property) located between Mashpee
