Article 17 To see if the Town will vote to amend Section 174-92 of the Zoning By-law by adding the following new sentence: "At its discretion, the Board may also elect a Vice-Chairman," or take any other action relating thereto. Submitted by Zoning Board of Appeals and Planning Board Explanation: The state Zoning Act mandates only that the ZBA elect a Chairm an and a Clerk. This article would specifically authorize the election of a Vice-Chairman, which has been the practice of the Board for many years. The Board of Selectmen and the Finance Committee recommend approval. Planning Board voted at a Public Hearing held on April 20, 2005 5-0 to recommend approval. Motion made by Don Myers. Motion: I move Article 17 be voted as printed in the warrant, with the exception of the phrase, "or take any other action relating thereto". Motion passes unanimously at 938 p.m. Article 18 To see if the Town will vote to amend Section 174-24.C.(9) of the Zoning By-law to read as follows: "Special Permits which have not lapsed under the provisions of Subsection (8) above may be modified by the original special permit granting authority, with any vote requiring approval of four of five members of the Planning Board or Zoning Board of Appeals as follows-,"' or take any other action relating thereto. Submitted by Zoning Board of Appeals and Planning Board Explanation: The ZBA was recently expanded from 3 to 5members. However, as it currently reads, this section still requires a unanimous vote of the ZBA to modify a special permit, as is required by the state Zoning Act for 3 member boards. This article amends the requirement to 4 of 5 members as provided in the Zoning Act for 5 member boards. The Board of Selectmen and the Finance Committee recommend approval. 52
