Article 17 <br /> To see if the Town will vote to amend Section 174-92 of the Zoning By-law by adding the <br /> following new sentence: <br /> "At its discretion, the Board may also elect a Vice-Chairman," <br /> or take any other action relating thereto. <br /> Submitted by Zoning Board of Appeals and Planning Board <br /> Explanation: The state Zoning Act mandates only that the ZBA elect a Chairm an and a Clerk. <br /> This article would specifically authorize the election of a Vice-Chairman, which has been the <br /> practice of the Board for many years. <br /> The Board of Selectmen and the Finance Committee recommend approval. <br /> Planning Board voted at a Public Hearing held on April 20, 2005 5-0 to recommend <br /> approval. <br /> Motion made by Don Myers. <br /> Motion: I move Article 17 be voted as printed in the warrant, with the exception of the phrase, <br /> "or take any other action relating thereto". <br /> Motion passes unanimously at 938 p.m. <br /> Article 18 <br /> To see if the Town will vote to amend Section 174-24.C.(9) of the Zoning By-law to read as <br /> follows: <br /> "Special Permits which have not lapsed under the provisions of Subsection (8) above may be <br /> modified by the original special permit granting authority, with any vote requiring approval of <br /> four of five members of the Planning Board or Zoning Board of Appeals as follows-,"' <br /> or take any other action relating thereto. <br /> Submitted by Zoning Board of Appeals and Planning Board <br /> Explanation: The ZBA was recently expanded from 3 to 5members. However, as it currently <br /> reads, this section still requires a unanimous vote of the ZBA to modify a special permit, as is <br /> required by the state Zoning Act for 3 member boards. This article amends the requirement to 4 <br /> of 5 members as provided in the Zoning Act for 5 member boards. <br /> The Board of Selectmen and the Finance Committee recommend approval. <br /> 52 <br />
