from the Land Bank Fund $39,250 to the Issuance of Debt Account; and further, the Town vote <br /> to authorize the Board of Selectmen to apply for and accept Federal, State and / or County grants <br /> to be applied by the Town toward the financing of this purchase, and to enter into contracts or <br /> agreements with Federal, State and/or County agencies, private conservation trusts or other <br /> entities or persons in connection with the purchase of all or a portion of such land and its <br /> preservation and mana gement for the purposes identified in Chapter 293 of the Acts of 1998, <br /> including conveyance and enforcement of a perpetual conservation restriction on the land in <br /> accordance with Chapter 184 of the General Laws as required by the provisions of Chapter 293, <br /> section 10 of the Acts of 1998 as amended, to an organization qualified and willing to hold such <br /> a restriction; and finally, to authorize the Board of Selectmen to enter into such agreements and <br /> execute any and all instruments as may be necessary on behalf of the Town to effect said <br /> acquisition, sale, transfer or preservation.. <br /> Moderator: I need a 2/3rds vote. <br /> Motion passes at 9:56 p.m. <br /> Article 21 <br /> To see if the Town will vote that those parcels shown on the 2004 Mashpee Assessors' Maps as <br /> Map 16, Block 36 (562 Cotuit Road and Map 44, Block 4 (59 Quashnet Road) shall not be held <br /> for by the Town as conservation land; and further, vote that said parcels shall be transferred to <br /> the Board of Selectmen for purposes of donation or sale to an entity or entities engaged in the <br /> development of affordable housing for sale or rental to persons of low or very low income within <br /> the meaning of the Housing Act of 1937, and qualifying for listing in the affordable housing <br /> inventory maintained by the Mass. Dept. of Housing and Community Development under G.L. <br /> Chapter 40B, with such transfer to be made subject to a permanent deed restriction, which may <br /> contain a reverter clause, permanently restricting the sale or resale price, or rental cost, of any <br /> homes or apartments constructed on said parcels to no more than that considered affordable for <br /> persons of low income as defined by the U.S. Dept. of Housing & Urban Development and <br /> qualified for continued listing in the above affordable housing inventory; and finally, to authorize <br /> the Board of Selectmen to make use of other instrumentalities of the Town or other agencies and <br /> to enter into any agreements necessary to effect the transfer of such land in accordance with this <br /> Article, or take any other action relating thereto. <br /> Submitted by the Board of Selectmen <br /> Explanation: This article would authorize the Selectmen to transfer title to two lots at 562 <br /> Cotuit Road and 59 Quashnet Road, previously taken by the Town for non-payment of taxes, to <br /> persons or agencies that would construct affordable homes or apartments. The lots would be <br /> developed with the approval of the Board of Selectmen under the "Local Initiative Program" and <br /> G.L. Chapter 4013, as was done with a number of lots previously deeded by the Town to Habitat <br /> for Humanity. The lots would be permanently restricted for use for affordable housing and <br /> would be transferred to an agency or organization selected through a "Request for Proposals" <br /> process. <br /> The Board of Selectmen and the Finance Committee recommend approval. <br /> 56 <br />
