This purchase, which could qualify for 52% funding by <br /> the state I is proposed in order to move one step closer to completing the corridor protection plan <br /> as well as reducing potential future nitrogen contamination of the river due to residential <br /> wastewater systems. In addition, it will facilitate both the completion of a proposed "Cross- <br /> Cape" hiking trail from Sandy Neck to South Cape Beach and the heritage corridor project <br /> proposed by the Wampanoag Tribal Council and endorsed by the Board of Selectmen. <br /> Recommendation: Finance Committee recommends approval. <br /> Motion made by Selectman Costa. <br /> Motion: I move the Town vote to authorize the Board of Selectmen to acquire, by purchase, for <br /> conservation purposes, a parcel of land, being that land shown on a "Plan of Land in Mashpee, <br /> Mass. Prepared for Rita A. Lopez, et. als." dated December 8, 1996, by Saunders Surveying <br /> Services of Salem, NH, containing 15.22 acres more or less, said land also being a portion of <br /> that parcel shown on the 1995 Mashpee Assessors Maps as Map 45, Block 9, generally located <br /> east of the Mashpee River on Meetinghouse Road opposite its intersection with Goodspeed <br /> Meetinghouse Road, to be held in the care and custody of the Conservation Commission <br /> pursuant to Massachusetts General Laws Chapter 40, Section 8C- and further, the Town vote to <br /> appropriate $150,000, including expenses incidental and related thereto, and to raise such <br /> appropriation , the Treasurer, with. the approval of the Selectmen, be authorized to borrow <br /> $150,000 under and pursuant to Chapter 44, Sections 7 and 8C and, if applicable, Chapter 40, <br /> Section 8C, of the General Laws, or any other enabling authority, and to issue bonds or notes of <br /> the Town therefor; and further, the Town vote to raise and appropriate $500 to the Issuance of <br /> Debt Account; and further, the Town authorize the Board of Selectmen and/or Conservation <br /> Commission to apply for and accept Federal and/or State grants, including reimbursement under <br /> Chapter 132A, Section I I of the General Laws, the "Self-Help Act," to be applied by the Town <br /> toward the financing of this purchase, and to enter into contracts or agreements with Federal <br /> and/or State agencies, private conservation trusts or other entities or persons in connection with <br /> the purchase of such land and its preservation for conservation purposes; and finally, the Town <br /> authorize the Conservation Commission and the Board of Selectmen to enter into agreements <br /> and execute any and all. instruments as may be necessary on behalf of the Town to effectuate <br /> said acquisition. <br /> Motion passes unanimously at 9:20 p.m. <br /> Article 37 <br /> To see if the Town will vote to amend Chapter 170 of the Mashpee Code, Waterways, by <br /> deleting the current text in its entirety and substitute the following: <br /> "Chap�ter 170 <br /> WATERWAYS, USE O�F <br /> §170-1.
