He could develop it under present zoning and do what he wants. He could sell it off <br /> and we could be doing this with 10-15 individual developers that we don't know and trust. We know <br /> what he has done so far, let's collaboratively and positively keep this communication going, Mr. O'Hara <br /> is right there are still negative comments, let's come to an agreement knowing it has to be good for us <br /> and the Commons or it will not move forward. There are a lot of benefits here and in working together <br /> we can create the best Mashpee. <br /> Ms. Waygan mentioned the need for consultants. For example, the project is proposing innovative <br /> parking and sharing of parking, with that we need to think about accessibility with an ADA consultant as <br /> the aging population has mobility challenges. An economic specialist needs to review or interpret a <br /> fiscal impact study to make sure we understand the taxes generated, if there is a tax burden or tax <br /> benefit for the project. We also have to think about the residential component... <br /> Madam Chair Sherman asked if anyone has any more questions for Ms. Senatori as much of this <br /> dialogue can be discussed amongst one another. <br /> Mr. Hansen stated with the DA being 25 years, it establishes a long playing field and gives the <br /> developer a chance to figure out what his plan is and not have any road blocks. He could see the <br /> benefit in having this project in 5 phases, so each phase can assess the performance and mitigate risk. <br /> He wanted to know if those considerations can be part of the agreement. Along with a lengthy <br /> agreement of 25 years, is there any performance bonds associated with previous agreements and will <br /> there be any associated with this one? <br /> Ms. Senatori referenced it being part of the DA process. Larger systemic projects that need phases with <br /> multiple uses, it is part of the projects proposal and is incorporated into phases, also why a lengthier <br /> agreement makes sense. We will be looking at all the impacts and if there are certain strategies to <br /> mitigate some impacts, those will be incorporated in the DA itself. She would consider all those things <br /> but cannot go into more detail until there is more substance. <br /> Chairman Fulone says it has taken 35 years to get what we have today. It has been in development for <br /> that long. Secondly, he is personally grateful the Commission is involved as he can't imagine the Town <br /> and Mashpee Commons doing this candidly without the Commission in place. The resources and <br /> expertise will be appreciated. <br /> Mr. Weeden wanted to make a note of something that bothered him earlier. If the documents were all <br /> handed in, it sounds like there is discretion on part of the Commission to require all documents by <br /> deadline in their entirety. This is different than a DRI, but CCC wants to support the application. He was <br /> bothered by their support towards the application, as a regional authority the loyalties should be with <br /> the Town more so than the applicant. He wanted to call attention to that. <br /> Mr. Gottlieb said if they came with all documents, CCC is damned if they do damned if they don't in this <br /> position. They work with applicant to bring forward the application and we all need to make the <br /> 12 <br />
