He <br /> does not think the scoping memo they are referring to is saying only study this piece and be over. He <br /> thinks they are saying we have this whole and are going to study this piece first then study each <br /> segmented piece, then further study each individual segment of that piece. <br /> Ms. Waygan wants that clarified with a neutral opinionated consultant on their side. <br /> Mr. Callahan doesn't want to start paying for someone without any idea of what we are doing or how <br /> long the consultant will be needed. <br /> Mr. Balzarini thinks with a new grocery store going in near the Commons, probably an additional 300 <br /> cars a day in the area. He also mentioned the biking and walking, not many people are going to utilize <br /> foot and bike trails in the colder months. <br /> Mr. Phelan wants to find out if the responsibility to finance a consultant relies upon the Town or the <br /> applicant. <br /> Mr. Lehrer mentioned the zoning defines the applicant pays for additional consultants. He hasn't seen <br /> anything in the Development Agreement that would define that. <br /> Ms. Waygan asked if they could hear from the Chief Procurement Officer in the room to establish what <br /> our resources are currently in the Town to be able to pay for this study. <br /> Rodney Collins, Town Manager has said publicly to the Selectmen, and he will state again, the Town <br /> has a line item for legal engineering consulting and generally there is a turn back each year. We cannot <br /> always plan for the unanticipated and this is one of those scenarios. He needs two things. He will need <br /> a vote from the Planning Board or Board of Selectmen to suggest that a consultant be hired. The <br /> second part is to list the scope. Is it traffic that you want to study, is it the environmental impact? It may <br /> be more it may be less, whatever it is, the Town has the funds that would be available for that purpose. <br /> He would defer to the Town Planner in terms of whether the applicant may be responsible. In order for <br /> it to be credible and validated for the protection of the Town's interest, the person doing the work is <br /> retained for the purpose of the Town's best interest and nobody else's. If that is the focus then the <br /> findings would certainly go a long way in determining whether the scope and study carries the weight it <br /> should. There needs to be full impartiality, thoroughness, and competence. <br /> Mr. Callahan says if we can find a way to get a third party impartial with Mashpee Commons paying for <br /> it would be ideal. <br /> Mr. Balzarini said if we make it a special permit we can do that. <br /> Ms. Waygan stated that the applicant needs to be aware they are paying for it. You have to say we are <br /> withdrawing until you agree to pay for these consultants. <br /> Mr. Balzarini wants to take a vote on this. <br /> 4 <br />
