MEETING MINUTES <br /> MASHPEE ZONING BOARD OF APPEALS <br /> SEPTEMBER 11,2019 <br /> The Attorney and Mr. Bonvie had discussions regarding the legalities and consequences of <br /> "road takings". <br /> Scott asked if the road was included in the overall lot coverage when the calculations were <br /> made. Chris King could not answer that question. <br /> Jonathan said that one of the other items the Board asked was that a registered land surveyor <br /> stamp and sign the plans specifically in reference to the paper road with bearings and <br /> distances of the paper road and the lot. Is the road part of the 50,965 sq. ft.? Does that <br /> include the road? <br /> Scott read aloud footnote 16, under Section 174-31 of the bylaw. Attorney Kirrane said <br /> that the road is a paper road that doesn't exist on a plan is part of the lot at present. He <br /> doesn't believe anyone will build on it. Ron said that he would want to see an engineer's <br /> stamp that the property is part of that lot. <br /> Scott said as one member,he would want to know the answer if the paper road is included <br /> in the lot coverage calculations. Jonathan wants to know the size of the lot. Attorney <br /> Kirrane said that it's a pre-existing non-conforming lot. Ron said that he understands, but <br /> there would be other discussions or topics whether using it or not using,and who has rights <br /> over it. He said as one member he is concerned about this. <br /> Scott said as one member he is not comfortable voting on the Variances without knowing <br /> more about the road. <br /> Chris said that he believes he has time until the next meeting to provide an exhibit that will <br /> clearly show the square footage associated with Wampanoag Ave, even though the two <br /> bearings run side by side, and they can certainly be added, and the resulting square foot <br /> associated with the lot not included in the areas of Wampanoag Ave. Also a written <br /> certification regarding bullet Item number 3, rights to passages and ownership of the <br /> possible paper road. Ron said that as one member, if those rights of passage are such that <br /> the street could be utilized by people in the back area for various reasons are the concerns. <br /> He knows it is a little farfetched but this would need to be provided other than a piece of <br /> paper. Attorney Kirrane said that is why he applied for variance relief from that road. <br /> Jonathan mentioned that there is also documentation provided for the traffic study and the <br /> storm water management. Chris said that he provided the calculations demonstrating that <br /> the system is still adequate for the provided 100-yr storm event. <br /> Jonathan asked what the half-circles where on the plan. He also wanted confirmation <br /> regarding the cut-through. Chris said there is no cut-through in the front; only in the back <br /> of the building. Chris said he can put speed-bumps on the cut-through if requested and can <br /> be conditioned if approved. Chris said that they will move the drive through back from Rte. <br /> 151. <br /> 9 <br />
