MEETING MINUTES <br /> MASHPEE ZONING BOARD OF APPEALS <br /> SEPTEMBER 11,2019 <br /> Kim Hazarvartian, Principal/Traffic Engineer with TEPP LLC introduced himself to the <br /> Board. He prepared a traffic assessment memorandum dated September 11, 2019, and he <br /> discussed the bullet points as presented in his written document. Some points listed by Mr. <br /> Hazarvartian described shared access points within Andy's Market along Rte. 151 and the <br /> driveway on Ninigret Avenue both of the access points are as far as practicable from Rte. <br /> 151 and Ninigret Avenue intersection which is appropriate and good planning. He spoke <br /> of the Cape Cod Commission's analysis of the average daily traffic counts during the <br /> summer months, and off-season months which is listed in his report. <br /> Mr. Bonvie wanted to get a perception of the traffic flow instead of looking at just the <br /> numbers. <br /> The Board wanted to know what the off-hours were for the tractor trailer. Chris said that <br /> the off-hours would be when the store has calculated peaks, either in the morning or <br /> afternoon. Loading will take place early mornings within the Town parameters or later in <br /> the evening. Chairman Furbush wanted to know the time and hours from the other Dollar <br /> Stores in the other communities. Chris said he can research that information. <br /> Mr. Bonvie asked Charlie Maintanis if there was any prohibitions or guidelines as to when <br /> deliveries can be made for these locations. Charlie said this would be made through the <br /> Special Permit. Mr. Bonvie is concerned with off-hours and these trucks idling behind the <br /> building next to the adjacent homes. Mr. Goldstein asked if there are certain times for <br /> dumpster pickups. Charlie said the bylaws are limited and would be disturbing the peace. <br /> Chris said that he can research the preferred loading operation and time frame, and how <br /> many employees would be stocking the store. The Board said these are the concerns of this <br /> type of business. <br /> The Board wanted to know the store hours. Chris said that they would be open between <br /> 8:00 am and 9:00 pm. <br /> Chairman Furbush said there are concerns with the traffic and wants to know if a traffic <br /> light is warranted. Mr. Hazarvartian said that in his professional opinion that this project <br /> would not create a need for a light. He said that it is a very complicated process requiring <br /> a justification study for a signal warrant analysis that is provided by the Federal Highway <br /> Administration. There needs to be certain levels of traffic on the main road, or a side road <br /> for 8 hours on a typical day. There are also four hours warrants and peak hour warrants. <br /> The volumes in his study do not trigger a warrant. He said he did not perform an hour by <br /> hour count. He said it's not easy to meet those warrants. He said that a signal could cause <br /> rear-end collisions in an area.He said that Rte. 151 has a State number but its Town owned. <br /> It used to be that even though it's a Town road,you would require State approval,but going <br /> back 20 years, this is not required anymore. The Town can make the decision, and would <br /> require the Board of Selectmen approval for the ultimate decision because it is essentially <br /> putting a traffic regulation in place. An engineer would have to prepare the study and the <br /> Town would have to review that study. <br /> 10 <br />
