MEETING MINUTES
MASHPEE ZONING BOARD OF APPEALS
SEPTEMBER 11,2019
He said that some vehicles travel down Old Brickyard Road to avoid the traffic on Rte. 151
to get through to the neighborhoods. He asked the Board to consider the size of the building
because the variances requested could make the building that much larger.
Brian Anderson, with Andy's Market said he strongly disagrees with the traffic engineer's
report. He had discussions with the owner and thought when the property was developed
that he could share the entrance with that lot. He was asked 22 years ago by the Town
Planner to eliminate two curb cuts; one was eliminated on the abutting lot, and one was
eliminated on his lot which was combined to one curb cut on Wampanoag Ave. He said if
this lot is developed, he said he is willing to change his driveway so they can both go in
and out in a two way fashion to the intersection. He said he had to research the issues of
the paper road. He is adamantly against the engineer's proposal of a one way drive way for
this project or any other proposed project.
Doug Semple asked the Board if they are closing the hearing tonight. Chairman Furbush
said the meeting will be continued because the applicants will have more to present when
they come back, especially questions regarding Wampanoag Ave. Mr. Semple asked if the
Board will be taking any more comments at the next meeting. Chairman Furbush said the
meeting will be continued to listen to the applicants, and most likely will close the next
meeting. The next meeting is scheduled on October 16, 2019, and will be very brief. The
Board will need to get some information that they requested; such as a summary, and then
vote.
There were other residents from other locations in Town that spoke on the same issues
relating to the traffic in that area, the request for several variances, the size of the building,
and saying it is a detriment to the character of the neighborhood.
Attorney Kirrane said that he believes that the building is one of the more attractive
buildings proposed in that stretch on Rte. 151. He requested a copy of the letters that were
submitted to the Board. He said he will comment on some of the discussions raised at the
next meeting. He doesn't disagree that other uses would be more attractive than some but
other uses in some cases would create even more traffic in a smaller building than what is
being proposed for this particular use in this size building. He cannot recall any lot where
there are three streets that impact a use on a lot, and the many uses that were on that lot
before where uses that predated any of the current zoning requirements that exist today. He
will comment at the next meeting on some of the letters that were submitted.
Mr. Bonvie made a motion to accept the applicant's request to extend this hearing until
October 16, 2019. Mr. Goldstein second, yes. All were in favor.
OTHER BUSINESS
Sharon moved to approve the meeting minutes dated August 28, 2019. Mr. Goldstein
second, yes. All were in favor.
12
