MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A MODIFICATION OF (V-2018-16) <br /> Owners;Jacques Morin and Martha Morin <br /> 11 Hamblin Road, (Map 120 Parcel 34) <br /> Mashpee, MA 02649 <br /> MOD-2019-61 <br /> Sharon asked if the deck increase would require a Variance for the wetlands. Mr. Morin <br /> said that Drew, Conservation Agent gave him an administrative approval. The Board <br /> reviewed the plan and wanted to confirm the current location of the hot tub, and the lot <br /> coverage percentage. It was determined that it was on the previous site plan that was <br /> approved back in 2018. The revised plan shows depicts the "proposed" dwelling because <br /> the house is still under construction. Charlie said the as-built foundation was approved,but <br /> because there is an extension of the deck, he will request another as-built. <br /> Sharon read the Conservation Department comments into the record. Sharon read the <br /> abutter letter into the record. <br /> In view of the foregoing,the Board determined the Petitioner met the criteria for a Variance <br /> modification of an approved Variance(V-2018-16)issued to Jacque and Martha Morin, 11 <br /> Hamblin Road. The modification actually reduces the lot coverage by locating the hot tub <br /> under the deck, and expanding the deck on the dwelling by exactly 1 ft. 9 inches as shown <br /> on the plan. Upon motion duly made and seconded at the Public Hearings on Wednesday, <br /> December 11, 2019, the Zoning Board of Appeals voted unanimously to issue a <br /> modification of an approved variance with the following conditions; <br /> 1. The Board has determined that the applicant meets all the conditions of a <br /> Modification under Mass General Law 40A Section 10. <br /> 2. Site Plan: Septic System Design Plan, Prepared by: Cape & Islands Engineering, <br /> Owner of record: Jacques & Martha Morin, 11 Hamblin Rd, Mashpee, MA.
