MASHPEE ZONING BOARD OF APPEALS MEETING MINUTES FEBRUARY 24, 2021 Mr. Bonvie mentioned that he believes these lots are merged and under Chapter 40A Section 6 the Board is bound by the laws of the State, and not sure how he can change that. Kelly Kooharian is an abutter and is concerned that these lots are considered abandoned. Attorney Polloni answered and said that these lots have never been built on. He believes that she was referring to the bylaw §174-19. Mr. Polloni is concerned on how these lots will be used if kept vacant. Mr. Bonvie made a motion that the Board grant an appeal to Jonathan M. Polloni, Esquire, of 11 Valley Road. Referencing the Building Official's Decision under M.G.L. Chapter 40A §§8 and 15 and §174-21 of the Zoning Bylaws to deem the lot buildable on property located in an R-5 Zoning District, Map 50 Parcel 13, Mashpee, MA. (Owner of Record: Malcolm E. MacDonald, Trustee of the MacDonald Land Trust.) Mr. Gould seconded, to deny. Mr. Goldstein, to deny Mr. Bonvie, to deny Mr. Blaisdell, to deny, Mr. Furbush,to deny. The Board unanimously denied the Appeal for 11 Valley Road and upheld the decision of the Building Commissioner. Mr. Bonvie made a motion that the Board grant an appeal to Jonathan M.
