Failure of the Planning Board to give such notice <br /> will only extend the cure period for the recognized mortgagee, <br /> pursuant to the provisions provided for above, and shall not <br /> constitute a waiver bf any default. The Planning Board hereby <br /> a ves the transfer of applicant's rights under this special <br /> pe-mit to any recognized mortgagee which results from the <br /> deiaul ! under a construction mortgage from the applicant to any <br /> recognized mortgagee. The Planning Board will not unreasonably <br /> withhold or delay its consent to a transfer of the rights under <br /> this special permit from any recognized mortgagee which has so <br /> acquired rights under this special permit, to a proposed trans— <br /> feree reasonably acceptable to the Planning Board. The pro— <br /> posed transferee must be able to demonstrate to the Planning <br /> Board a reasonable ability to complete the project in accord— <br /> ance with the terms of this special permit. <br /> 22. The applicant shall supply to the Planning Board five (5) <br /> copies of the Site Plan, and all drawings which form a part of <br /> this Special Permit, as initialled by the Board Chairman, <br /> following approval and before undertaking any work authorized <br /> by this Permit. <br /> ;• VI . Expiration, Extension or Modification <br /> �7 <br /> Pursuant to Massachusetts General Laws Chapter 40A <br /> � p , Section 91 and <br /> the toning By—law, this special permit shall lapse within two <br /> years, which shall not include such time required.to pursue or <br /> await the determination of any appeal from the grant hereof, if a <br /> substantial use hereof has not sooner commenced except for good <br /> cause or, in the case of a permit for construction, if construction <br /> has not begun by such date except for good cause. The applicant <br /> s shall request a specific determination of good cause by the Board <br /> if claiming an extension of the two year period except to await the <br /> determination of any appeal from the grant hereof. <br /> Modification of this permit shall first require a determination by <br /> the Board whether the proposed modification would be a significant <br /> rr� <br /> change requiring a new public hearing. If no hearing is determined <br /> to be necessary, the Board may make such change at a regular public <br /> meeting. If a public hearing is determined to be necessary, the <br /> eJf rules, regulations and time periods required for a new special <br /> permit appication shall be followed. <br /> VII.
