party completing the work that the basins have been cleaned. <br /> Should said cleaning not be completed, the Town of Mashpee may <br /> clean said catch basins, or cause them to be cleaned, at the <br /> expense of the owners of the land, and such costs shall become <br /> a lien against the property. <br /> 1d. A deed restriction shall be imposed requiring that all ferti- <br /> lizers and pesticides used within the development shall be of a <br /> type approved by the Town of Mashpee Board of Health and <br /> applied by licensed applicators and that use of fertilizers and <br /> pesticides shall be minimized, and the use of natural pest <br /> control methods should be encouraged. The Applicant and sub- <br /> sequently a homeowners association shall provide the local <br /> Board of Health with a complete list of any such fertilizers or <br /> pesticides used on common property and their method of storage <br /> on the site. Deed restriction shall limit lawn areas to 2000 <br /> square feet for each dwelling. <br /> 17. A deed restriction shall be imposed requiring that no under- <br /> ground storage tanks shall be installed on-site for any <br /> purpose. <br /> 18. All conditions of this special permit shall be binding not only <br /> on the applicant but on all successors in interest and assigns <br /> of the applicant. <br /> 19. No occupancy or building permits shall be issued while there <br /> exists any violation of the conditions of this Special Permit <br /> unless the Board, by a favorable vote of four members at a <br /> regular meeting, allows said issuance. <br /> 20. Transfer of this special permit and any rights created by said <br /> permit, except by foreclosure by a lender, shall require the <br /> prior approval of the Mashpee Planning Board by a vote of at <br /> least four members at a public meeting. Planning Board <br /> approval will not be granted if any violations of the special <br /> permit exist. <br /> 21 . Notwithstanding the provisions of 18 above, the developer/ <br /> applicant and his heirs and assigns shall have the right to <br /> pledge and assign, as part of the mortgage collateral , its <br /> rights under this special permit to any institutional con- <br /> struction lender which has given written notice to the Planning <br /> Board of such assignment. Upon receipt of the written notice, <br /> said lending institution shall become a 'recognized mortgagee' . <br /> All such notices shall be sent to Mashpee Planning Board, <br /> Mashpee Town Hall , 16 Great Neck _Road North, Mashpee, MA 02649, <br /> by certified mail , return receipt requested. In the event of a <br /> default by the applicant under the terms and conditions of this <br /> special permit, the Planning Board shall give written notice of <br /> such default by certified mail , to the applicant and each re- <br /> cognized mortgagee. Upon receipt of the Planning Board notice, <br /> any recognized mortgagee so notified shall have sixty (60) days <br /> from the date of receipt of such notice, to remedy any such <br /> default.
