change shall be submitted to the Planning Board, which will <br /> determine at a public meeting whether the changes are <br /> significant or warrant additional Board review and action or <br /> public hearings for revision of the Special Permit. <br /> 9. The app1 ; - _nt shall incorporate a homeowners association to own <br /> and mai� pxin all streets and common areas not transferred to <br /> the Town. <br /> 10. The applicant shall require that all construction personnel <br /> working on the project shall be familiar with the provisions of <br /> MGL Chapter 38, Section 68, regarding the discovery of human <br /> remains. <br /> 11 . The applicant shall mark the' boundar i es of all open space areas <br /> by tape or similar device prior to any construction and with <br /> stone or concrete boundary monuments prior to the release of <br /> the covenant for the subdivision roadways. The applicant shall <br /> require that all construction personnel working on the project <br /> shall be familiar with all applicable provisions of this <br /> special permit. Notwithstanding the aforesaid, the applicant <br /> shall be solely responsible for all violations of this special <br /> permit by construction personnel . <br /> 12. The applicant and all contractors, subcontractors and employees <br /> engaged by the applicant as well as any parties involved in <br /> construction of structures on the lots shall properly dispose <br /> of stumps, construction debris, hazardous materials and other <br /> waste and shall provide a report to the Planning Board and <br /> Board of Health, upon completion of the project, describing the <br /> amount of, and means of disposal of, such materials resulting <br /> from the construction of the project, including the approximate <br /> date and specific location at which such materials were <br /> disposed. <br /> 13. No household hazardous wastes shall be introduced into septic <br /> systems. To encourage compliance with this condition the <br /> applicant shall so state in deed restrictions, homeowners <br /> association by-laws and the declaration of covenants, condi- <br /> tions and restrictions. The applicant shall also inform lot <br /> buyers of the adverse impact that hazardous materials will have <br /> on the project's water wells and septic systems and expressly <br /> prohibit the residents from using their kitchen and bathroom <br /> facilities for the disposal of hazardous wastes. <br /> 14. No de-icing chemicals other than a mixture of sand and calcium <br /> chloride or sand alone shall be used on any roadways, driveways <br /> or other impervious surfaces of the project. <br /> 15. Oil/gas separators shall be used in all catch basins and said <br /> basins shall be cleaned on an annual basis. The applicant and <br /> subsequently a homeowners association shall annually transmit <br /> to the Planning Board on or about the anniversary of the <br /> issuance of this special permit a written statement from the <br />
