notify the Planning Board. During said Thirty <br /> (30) day period, the Planning Board shall have <br /> the opportunity to review the construction and <br /> improvements in the phase then completed, and the <br /> Building Inspector, the Planning Board, or the <br /> Planning Department of the Town of Mashpee may <br /> seek appropriate remedies, including injunctive <br /> relief or an equitable action pursuant to Section ` <br /> 9 . 39 of the Zoning By-Laws for any violation of <br /> any term, condition or <br /> provision of this Special <br /> Permit Decision. The Board may require, prior to <br /> the commencement of any subsequent phase, the <br /> revegatation of disturbed areas . <br /> 8 . Construction of the project shall be subject <br /> to review and approval of final engineering plans <br /> by the Planning Board prior to the issuance of <br /> building permits in accordance with Section 9 . 39 <br /> of the By-law. <br /> 9 . The number of units to be constructed shall <br /> total no more than one hundred and seventy (170) , <br /> as shown on the final approved open space <br /> multi-family site plan signed on A. 1987 <br /> by the Planning Board Chairman. �� <br /> 10. That the waiver of the parking requirements <br /> of Section 8 . 6 of the Zoning By-law in finding 8 <br /> hereof shall be contingent upon an opinion of <br /> Town Counsel allowing said waiver, or, in the <br /> alternative, that a variance from said <br /> requirement be obtained from the Mashpee Zoning <br /> Board of Appeals . <br /> CONCLUSION <br /> The Board finds that the issuance of Special Permit <br /> Will further the intent of the Zoning By-Law and will enhance <br /> the public safety and public good. In addition, this permit <br /> may be granted without substantial detriment to the public good <br /> and without nulifying or substantially derogating from the <br /> intent and purpose of the By-Law, and comports fully with all <br /> requirements of Section 9 . 3 of the Zoning By-Law.
